Congrats. I don't see it as gloating at all. I thought we were here to

share-good and bad. Please be careful, keep those dances to little ones.

Hello Everyone,

Friday I went to see my attorney about some paperwork I received from SSA. I

think I am his first " non listed digestive disorder " case. And he had done

some " homework " . I would like to share some information he gave me from one

of his reference manuals on pre-hearing procedures:

The most common digestive system problem seen in ALJ hearings are

ones in which the primary limiting factor is DIARRHEA, with or

without

a colostomy or ileostomy. These impairments include irritable bowel

syndrone and Crohn's disease. The primary work limitations result

from

missing work and while at work having to spend so much time,

unpredicatbly, away from the work station, in the bathroom. There

also

may be associated pain, fatigue and frequently psychological

problems.

Once the diagnosis is established and psychological problems

corroborated

by a psychological evaulation, these cases need to be developed

primarily

with LAY EVIDENCE concerning attempts to work, frequency and

intensity

of symptoms. Have the claimant keep a diary for a month or so

before the

hearing describing the symptoms and keeping track of the frequency

of

diarrhea etc. In close cases, hire a vocational expert to give an

opinion on

the claimant's ability to work.

In our discussion regarding this he said that I (we) need to emphasize the

diarrhea as the primary disabling factor with plenty of mention of fatigue

and pain. It certainly couldn't hurt to focus on these symptoms, since our

disease is a not listed and it appears SSA will consider this factors

disabling. It is a matter of talking in the verbage they need to hear.

I felt pretty confident about my case leaving that appointment. Another

factor that boosted my confidence was I felt my lawyer and doctor were

willing to work together. He called my doctor while I was there to discuss

this. My doc had just received the paperwork from the state on my Medicaid

application and had not as yet completed it. Told my lawyer I looked upon

him as part of my medical team, as well he should be.

I hope this information will help those pursuing SSDI...........
