Guest guest Posted March 15, 2004 Report Share Posted March 15, 2004 I was thinking of taking a small tape recorder with me and taping my doctor everytime I go in from now on without his knowledge- would this be considered illegal? Asks the legal assistant- ( laws change )- gosh they sure can make you feel like a fool at times. ---------------- Depends on what you are going to do with it and how you are going to use it. Would it be legal as evidence in a court proceeding? Probably not because you would have to be able to prove that it was his voice and not someone else trying to sound like him. For starters. It not only would not be legal but you could be criminally cited yourself if you tried to tape a phone conversation with it without his knowledge. What would be perfectly legal, however, would be for you to bring it with you to your next appointment and take it out right in front of him and turn it on. Then, very innocently, you say something along the lines of " I have been having so much trouble with my memory lately that I decided I should just tape all this so I don't forget anything. " Something like that. Granted, it could really piss him off to the point where he suggests you go see someone else. On the other hand, get that on tape and wave it under his nose... The main point is that there really isn't a whole lot he can say about your taping everything in the open, whether he likes it or not. But, if you say you need it cause you can't remember anything lately, then he may think something else is going on - too much meds, alzheimers, who knows what - and send you to another dr or something. I like this doctor a lot , he is super careful with me etc......... I only meant using a recorder to kindly remind him that he did indeed say what I said he said........ I honestly don't think he would mind me taping him, if I said it like you have described below- that would be no problem..... guess the reason I said and hide it was basically so when the nurse says oh no- the doctor would not say that or do this, I could yank it out and say oh yah? How well do you know him? She wouldnt give him the telephone, -I did ask if it were possible to speak with him directly........ I think I will give that another shot this morning. There are about six gals working there in the office- each doctor has one secretary/nurse assigned to them..... well off and on- in the past as well- they tend to think they have doctors powers I guess you could say. A few times one would say- well - you should call before you are down to one morphine pill left- sometimes it takes 3 days to get dr to write another script! I said ok, so next time I called as she suggested, 5 days ahead- and got hollered at for that- stating that she had never said that before and doctor will not write it until you are down to one pill........ mercy- cant win for losing - and if you mention that you were told otherwise whew they have kittens...... I have my appointments set at every 3 months- which is great- but very painful for me to get in /out of vehicles- sure was hoping the dosage up on morphine would help with some of that- but so far no go but have only been on the higher dose for one month- which though I did have to readjust as I went a week without due to the nurses mix ups- and the pharmacists here really have a tizzy if you tell them they miscalculated......... I am housebound and have family pick up my medication and counted them this time- due to shortage last time and by golly, it was short- 1 pill.......... no big deal right??? So called to make sure they knew....... geesh- they swore up and down that was impossible and I must have a drug addiction etc if I was worried about 1 pill - when they did fill it properly...... Have given family instructions to have the pharmacist now count them out twice- in front of them before they leave the drug shoppe........ I guess the whole thing that is getting to me is they use the excuse that you are either addicted or too foggy from meds to have possibly retained correct info........ and they will point the finger at the wrong person....... I will deal with it by talking directly to the doctor- even if it means making an earlier appointment- which right now my body doesnt really treasure the idea but if its the only way I can talk to him directly- then I will do so and definitely give him a report on how his secretary and nurses are handling matters...... I just hate it when someone doesnt believe me- I have no reason whatsoever to lie...... and honestly I do think he needs to change the pain medication from lortab to something else- I still feel I have built an immunity to it. The morphine helps yes- but sometimes I take a few of the lorcet in between times to help take the edge off of the pain that one still has that makes them so they can't sleep...... am sure you know what I mean? And that you wish to speak to the doctor directly and if she refuses and you think the doc is up for it, I would have him tell the receptionists that when you ring they are to put you through. You have a RIGHT to talk to your physician and not to some nosy, know NOTHING secretary who is NOT a doctor or a part of your private consultations with your doctor, it is ILLEGAL for her to give you medical advice and to contradict your medical advice and as she does NOT know what was said or aggreed upon between you and your doctor she CANNOT comment on it. I wold tape the consultations as well and refuse to have these/this person run interference between you and your physician (especially as you are house bound and travelling in a car etc is so painful), she knows NOTHING about your medical probelms (except maybe what she has read in your file (and reading does NOT convey understanding), i mean if most if NOT ALL doctors do NOT understand what we go through then this person certainly doesn't and what is NORMAL for most of this doctors patients is NOT normal for you or anyone with EDS or a chronic pai problem as we do take extrodinary amounts of pain killers and are NOT drug addicts or seekers. I mean I take 160mg a day (100mg at night and 60mg in the morning) and I have liquid codiene for breakthrough pain and the choice to titre my MsContin dose about as needed (I can up to double one or both of my doses if I need to). It's a controlled med, and like you, he was shorted a couple times. It's for BOTH of your protection for them to do this - someone from the pharmacy could be pilfering a pill or two...if they know they're being counted right there, there's no way they OR anyone else can sneak a pill! It doesn't work, and I'm thinking I'm gonna get off it, cause it doesn't do the trick. So, what's the point? I don't want to take the drugs, but I simply cannot function without them. I do have good periods. This, my dr said, is the time to adjust the meds. Not during a bad period, or else he'll be adjusting meds every time I have a bad spell. (which I have more often than good). He won't give me anything for the bad days either. I told him I took some perocet one day when I couldn't stand it, and I was able to get on with things. So, it just goes to show that I'm not getting enough meds to help me function. But, he still won't give me any more. It's all so frustrating. So, in the mean time, I'm waiting to hear from the sleep dr, and find out if there is something he's gonna do to help me. I'm hoping that if I do have a sleep disorder, maybe getting that under control will help with the pain in the long run. Maybe I'll be more able to get things done if I'm not so tired. When I'm not so tired, maybe I'll be able to deal with the pain issues easier. You know, like do my relaxation tapes, do my excercises, etc. I do my relaxation tapes now, and end up falling asleep for a couple hours. I can't do my exercises lately cause I hurt. It's this spiral, that's slowly pulling me down. Anyway, I like my pain dr too. A lot. He and his nurse are both very compassionate, caring, understanding, etc. But, I wish he could just see things my way. But, I suppose he wants me to see things his way. I'm hoping that if I do have a sleep disorder, maybe getting that under control will help with the pain in the long run. Maybe I'll be more able to get things done if I'm not so tired. When I'm not so tired, maybe I'll be able to deal with the pain issues easier. You know, like do my relaxation tapes, do my excercises, etc. I do my relaxation tapes now, and end up falling asleep for a couple hours. I can't do my exercises lately cause I hurt. It's this spiral, that's slowly pulling me down. Anyway, I like my pain dr too. A lot. He and his nurse are both very compassionate, caring, understanding, etc. But, I wish he could just see things my way. But, I suppose he wants me to see things his way. I know where I live there seems to be a pharmacy on every corner. That would probably stop the shortages. My FIL, who died of Lou Gehrig's Disease (ALS), was on a medication to help control his ALS. He was shorted in the past by Walgreens on my MIL's meds (Zoloft) before, so he got smart and would mark on the calendar the day he started taking the expensive ALS meds. He would also count them out to be sure. One month he was shorted TEN pills at $15.00 a pill which came out to $150.00. I called the pharmacy, went down in person, talked several times to the manager, and got NO WHERE!!! They said it couldn't have happened because they opened a new bottle from the shelf. Apparently they didn't even count the pills...just repackaged them into one of there bottles. Just wanted to let you know that you are not the only one who has been shortened.... There is not a doctor in the world that would refuse when they are dealing with drugs - pain and triplicates!!!! Besides, when you are taking pain medication you may not be clear too ... it is a great safety net for you when you get home. Keep it in a file and take the file with you each time you go. Simple! Rite-Aid and handy as I do refills online. But most did not carry what the doctor would put me on so would have to wait a few days for them to order it, giving me re-adjustment time to the med and/or have my parents drive yet another 30 miles out of their way just to get them. Is there another pharmacy nearby that you could use instead (even if it is a different branch of the same pharmacy)? I know where I live there seems to be a pharmacy on every corner.
