Question about timing of ARD IEP meetings

Hello all,

I have a question for some of you more experienced parents. I have a

daughter who is deaf, 3.5 year hearing age with a CI. She is currently

enrolled in a regional deaf day school where she is receiving speech and

deaf ed support services (she is dual-enrolled there with most of her

day spent in a mainstream private school). We have an IEP in place for

this school year.

We asked for a meeting before the end of this school year to develop

's IEP for the next school year and determine her placement (i.e.

mainstreamed at home campus, mainstreamed with deaf-ed support at

regional day school, or placement in self-contained deaf-ed classroom).

However, the school district refused our request for having the meeting

in May. They want retested for IQ and achievement testing this

summer and then have an ARD/IEP meeting in August 1-2 weeks before

school starts. I signed an authorization for the testing yesterday.

Can they refuse to have the ARD/IEP meeting if we request it? Can they

refuse to hold the meeting in May and instead hold it over the summer?

Can they wait until right before the school year starts to determine

placement? Since I signed the authorization for additional testing

yesterday, does that give them a 60-day timeline for completing the

testing from yesterday? Or is there no timeline for " additional

testing " ?

Please advise as to your experiences or to your knowledge of IDEA

regarding this. Many thanks for your help!
