From what I hear this is just how it is done.

Unfortunately courts don't generally do their job and give plaintiffs

judgment on the pleadings in this kind of situation so a to discourage

the behavior in future cases.

Same thing that happened to perjury. Instead of it being a cut and

dry illegal activity, it's become a defense strategy. Instead of the

law that was created to protect the innocent, it's become a way to

prevent the guilty from having to face the consequences of their

actions.
