Moria and all,

If someone is selling the FAQs (or other material) from this forum,

or any related forum, without permission -- then that is a violation

of copyright law.

Each person who posts messages at a forum or bulletin board " owns "

the messages that he or she posts. No paperwork is required -- you

own your own words. No one else can use them without your

permission.

The FAQs may have been a joint effort, in which case all of

the " authors " share the copyright.

People should send e-mails to that eBay person and warn her that she

is in violation of copyright law.

Please note that the above sentence starts with IF.

IF is important here. I do not know what the seller is

selling, it could be simply information about this list,

like a URL, or a bunch of URLs. I don't know.

If you want to discuss which parts of the list are and are

not copyright, only some things are *explicitly* copyright.

Another point is that selling access to a group is

(I'm almost positive) prohibited by the terms of

service. But, again, I'm not sure what that includes, exactly.

AND I don't know what she is selling. So far as I am aware,

no one else here knows either.

depends what you mean by " FAQs " . If you mean the actual FAQ

file, it is almost entirely the effort of one person, who prefers

not to get credited (and therefore is not), and it does NOT

have an explicit copyright statement (although it has been

considered some). (There are several list angels over the

years who have asked not to be credited, simply want to

help out.)

If you mean all the files in FILES, lots of various authors,

and various people uploaded them.

If you mean the files I've written, almost all of them have

an explicit copyright statement (some exceptions).

I personally would recommend no such thing, since I don't know

if that is the case!

Looks like a comment like " kandy apparently doesn't care about ethics or

copyright law, no shipping " would fit. All other items she has posted consist

of trainings, and require no shipping.

Wait until you hear this atrocity. Last week e-bay was selling a

particle of the body of St. Ann Seton who was my husband's

great, great grandmother. Of course, he notified them about it to

try to stop the sale. But, nothing happened. We were very appalled

about this.

I also agree - she's netting maybe 50 cents for this, after her fees. Not

exactly a pyramid scheme.

Hello,

I am new to this group and it was through Kandy that I found it. I

was searching on ebay for anything involving Autism, as my 3 year

old son was diagnosed early last year and I am desperately trying to

find anything that will help him! I saw her add which stated there

was help for autism and she would send me the info if I was the

winning bidder. It only cost me a dollar! I am a seller on e-bay and

am well aware of the cost of listing and selling. I assure you she

can't be making any money after listing costs. I just wanted to say

that this may not be considered one of the most ethical ways of

spreading this information, but it brought me here and I am greatful

for that! Ebay advertises to millions of people and if her listings

bring even one perspn to this group and they are able to help one

child I think it's a good thing. I could see if she was making money

off of this, but she can't be with such a low bid price. Her add

does not offer anything, but information, which is what I got.I

don't know Kandy so I can't say what her motives are, but I'm just

glad I may have found some answers for my son.

Wouldn't it be a good idea to write to kandy and see what is up? It

sounds like she might be trying to cover a listing fee, and it just

might be that she is simply offering her own experience which would

be hers to offer. If she did get help from this group and

states 'this is the group I got help from' and then supplies the link

and nothing more, then that is also within her realm because it is

part of her story. I prefer to get a few more facts on the table

before rushing to to such harsh, negative, and possibly erroneous

judgement.

Kandy is a professional " network marketeer " of pyramid schemes, and

certainly was careful to construe her sales pitch in order to make it

fit through the legal loopholes. She is selling link to the Andy's

FAQ file on this forum and a link to subscribe to this forum, indeed

embedding it into her personal testimonial - which is based on advice

received from this board. It is obviously done to allow her

to " copyright " link to someone else's intellectual property as part

of " her own story " - similar to all our stories we share for free.

This is an excerpt --

" WHO CAN CLAIM COPYRIGHT? Copyright protection subsists from the

time the work is created in fixed form. The copyright in the work

of authorship immediately becomes the property of the author who

created the work. Only the author or those deriving their rights

through the author can rightfully claim copyright. "

There is no problem with the question of whether something has

copyright protection -- if none of the people whose words are being

used care one way or the other.

Therefore it may be that the e-mails that " Kandy " is sending are not

a problem. But maybe they would be, for a few people, depending on

what is contained in them.

Each time someone writes a message, they are the " author " of that

message. And if they have an interest in not having anyone else

duplicate it, or use it as part of a publication, they immediately

have that right. If they want to enforce that right, they will then

have to go through the copyrigt paperwork.

Maybe Kandy's motives are very good. But her methods leave

something to be desired.

Please go reread my post: my point was that it is not the

least bit clear that she is selling something that someone

else wrote. The GUESSES and SPECULATION that I've heard

say that she is referring people to this list.

The URL of this list certainly is NOT copyright, and

is a creation of , FWIW.
