Or as mentioned earlier is he sueing everyone that may have some fault in the death in order to be able to collect from the companys insurance? Answer to Question 2: I recommend personal insurance. I buy HPSO myself. Even if you never get sued, it pays up to $10,000 to defend your certificate if DSHS gets after you and tries to take it; $2,500 for a lawyer to go with you if you have to give a deposition as a witness, and a bunch of other stuff that's not covered by your employer's policy and that would not be provided by your employer. I pay $185 as a paramedic/instructor/with the consultant and witness rider. That's for $1,000,000/$3,000,000. You can't beat that. That's about 1/2 the average lawyer's hourly fee. However, my question is and I'm sure other people have had this question before in the past is dealing with personal medical malpractice insurance as I have heard different views. Basically, if someone were to sue and the individual Medic gets named in the suit along with there employer and the resident mascot can the plaintiff legally take everything the individual Medic owns with the exception of there house and vehicle? Also, is it wise to purchase personal medical malpractice insurance so you will have an attorney looking out for your interest? HPSO has individual policies that doesn't cost very much. Just curious others viewpoint. If you have ins. and the more you have the more you invite lawsuits. . If you don't have insurance they can sue you for what you got, which in my case would be nothing. Oh they could ask for 20% if all future income until I paid of x amount, but good luck with that. Anyway in this case you made me think of another point. The pilot's family could sue the other two crew members, the dispatcher and a slew of other folks like the other HEMS service, Hospital that called, the weather man, and the weather man's estate. Suit vs counter suit = a draw. You can also sue FAA and the Fed Government, State Government, City, County, the Forest Service since the trees could have been lower, and it just unlimited. I always took the stand of don't offer anything to invite anyone to sue in the first place. Worrying about whether carrying extra liability insurance will invite more lawsuits is like worrying that carrying full coverage automotive insurance will cause your car to become an accident magnet. Bottom line, it all boils down to two things: 1. Nice guys get sued, but pricks get sued far more often, even if the care they provided was far superior to Mr. Nice Guy's. 2. Documentation will save your ass. It doesn't matter if the care was superlative if the documentation doesn't reflect it. To a jury, you are what you write. They just seem to always find my vehicle, just like the rocks flying from trucks and cars cracking my windshield. With all the massive ins. I have the deduct is higher than the damage. Answer to Question 2: I recommend personal insurance. I buy HPSO myself. Even if you never get sued, it pays up to $10,000 to defend your certificate if DSHS gets after you and tries to take it; $2,500 for a lawyer to go with you if you have to give a deposition as a witness, and a bunch of other stuff that's not covered by your employer's policy and that would not be provided by your employer. I pay $185 as a paramedic/instructor/with the consultant and witness rider. That's for $1,000,000/$3,000,000. You can't beat that. That's about 1/2 the average lawyer's hourly fee.
