SPeak with the ortho about it sqishing the ear... the holding points should hold it so that it stays centered. She may grow into the band... but for now you should speak with the ortho about it. I put it on straight and as soon as she starts moving it slips. My orthotist assures me that it's still working, and it doesn't seem to bother my daughter even thought it sometimes mushes her ears a little, but I'm getting really tired of defending it to everyone who remarks that it's crooked. Going into this process, I prepared myself for getting a lot of questions and comments on why she wears a helmet, but I wasn't prepared for the questions about why it's crooked.
