Guest guest Posted January 28, 2003 Report Share Posted January 28, 2003 Ok, Last night we spent almost two hours on the phone with our laywer. Fair warning...THIS IS NOT GOOD! talked to the social worker and now this is what is being said. The social worker has contacted his legal dept through CPS about all this. Now keep in mind we agreed to let him SEE the kids with our lawyer present in public, and we have sense moved to another county since all this started. Well, he has decided that he is NOT going to close the case, that he must inspect the house, talk to the kids and so forth and he is threatening court orders to get in the house, to talk to the kids, ect. Here is where we are confused and where is confused. We have paperwork stating that the investagation is CLOSED. Our lawyer has paperwork stating that all thier " issues " are resolved (these were educational, health and the house being messy). We have paperwork stating that we withdrew from their saftey plan (it was a bunch of bullshit stuff anyway. The original social worker was nitpicking on it). Not only that, the last anyone has heard from this guy was 6 months ago. If he was so damn worried about stuff why in the hell didn't he get a court order then? His last " visit " was a year ago. So where in the hell does this guy have any " just cause " to get a court order? said this is the most unusual case he has ever seen and is now wondering if our 4th admendment rights are being violated. Does anyone have any sort of logical explination for any of this? This is going to get much uglier I think before it is all over. He seems to think that your allowing him limited access is a weakness in your resolve. Personally, cancel the meeting and refuse services, then get to court before he does. I don't understand why this guy has any contact with you at all since the case is already supposed to be closed. WTF?? And, yeah, stick with your original plan. The only " logical explanation " I can possibly imagine is that with all the shocking stories of CPS dropping the ball of late that they are going overboard to try to prove they are doing their job. But I just don't believe that in this case here because of the paperwork saying it was closed, and the no-contact for 6 months. " Ridiculous " doesn't even begin to describe this. Do not have any more contact with him except through your lawyer. Get everything on paper and document every thing you have gone through. Outrageous. This man should be fired.
