Liberty EMS, the sole 911 provider for Vidor and the Emergency

Services District #1 for Orange County ceased operations Friday. They

laid off 40 employees, didn't provide them their payroll that was due

for the preceding two weeks, and left the city and ESD without EMS

coverage.Our patients are waiting about an hour for mutual aid EMS to

arrive now. The following is an excerpt from KBMT :

The sole ambulance company serving the Vidor area is closing it's doors.

KBMT 12 News has learned that Liberty EMS Company is shutting down.

Only 5 months ago, county officials voted to make Liberty the only

emergency medical provider for that area.

12 News reached Liberty by phone and a complany employee told us there

would be no statement regarding any potential layoffs.

Ambulance service will now be handled...At least for now... By stat

care and acadia priority.

(I think they meant Stat Care, Acadian and Priority One)

Liberty EMS is/was a locally owned private/for profic Emergency Medical

Transport Service. They did not run any 911 calls for the City of Beaumont,

even though they were located here. They were awarded the 911 contract in

Vidor, Texas, when Priority Care from Los Angeles, California withdrew from

that

city. It was my opinion, I restate my opinion, that they were a successfull

small ambulance company, with good employees.

I had always been a little suspect of the fact that they were owned by a

local physician, who transported patients all over the city. Not having any

knowledge of state requirements for ownership of a private service, I must say

that if I were a doctor and had multiple patients to transfer, what better way

to make more money than to open an ambulance service. But I do not know

what the restrictions are for that, and he must have followed those

restrictions

in his ownership or the state DSHS would have stepped in.

It was also being rumored that he had received a reprimand from the state

physician medical authority to receive more Continuing Education for evaluating

certain types of illnesses and was being mentored by a doctor or doctors in

his practice. It is also been stated by several of his employees that he was

undergoing a divorce. This is something that I have no personal knowledge

of. Things happen in businesses when divorce lawyers and accountants get

involved.

The bottom line is that this physician did not PAY his employees for their

last two weeks of work and gave no indication that this would occur up until

the paychecks were due. This is unforgiving and is seen more and more in this

world today.

They were good hard working employees that deserve better. I wish them and

everyone else that has had to endure these circumstances, over and over and

over, my prayers and condolences. It just ain't right.

Howdy:

I had the same thing happen to me,I lost one month of salary. I think its time

to push financial responsibility. EMSAT needs to get on top of this. I think

there needs to be a law to assure that EMTs will be paid, as I think that this

is a form of legalized theft and The wage commission and payday law is a JOKE. I

think any employer public or private who does this should be forced to pay a

double pay sanction if they do this. I feel the citizens and medics of Liberty

Hi Racheal:

Again,what excuses these actions? He sounds like he is having personal and

professional problems. There is a legal as well as moral obligations to pay his

employees. Payment of your employees is the top obligation. To me this is a form

of theft. In California,it is considered theft and could put him in jail for a

while. In Texas, its a joke and not taken serioulsy by the The Labor commission.

Our governor condones this activity and does not take any leadership concerning

this subject. This is typical, as I consider him

on a par with the worst leaders I have known in the military or civilian level.

We elected this person as no other candidate was considered capable according to

Texans. This will continue as long as we in EMS ignore it. I think this is a

priority for EMSAT to lobby for.

There are some old bad pics of me out there, but none in drag.? Those were

before cameras were invented.? I agree, this area is a never ending battle of

what EMS is not all about.? But at least we are not in Houston.

For those not yet aware, our attorney general has advised TDSHS that not paying

employees is fraud since the EMS companies recieve state and federal funds.

TDSHS now investigates those complaints. I would advise anyone with these types

of problems to contact their local rep and have these companies slapped with

fines on their licenses.

While I realize that we all can't have the perfect EMS job if such a thing even

exists, there's also such a thing as going into?a job eyes wide open.? A new

startup is more likely to bounce paychecks than a 30-year old city EMS

department. A " routine investigation " doesn't typically involve armed Federal

agents executing a search warrant. The same names of ambulance service owners

owning a new business doesn't mean that they've necessarily changed their ways.

While I realize that we're not all lucky enough to work for Henry Barber, Andy

Foote, or some of the other great EMS directors out there, we aren't completely

without fault when we fail to ask questions before we take a job.

And Sal, can you give us a citation or reference to that AG's finding?? Are you

referring to an opinion issued by Greg Abbott, the Texas Attorney General?

I can't see how you could get a fraud charge out of it unless you can prove

some misrepresentation in the inducement for going to work for them. It's

pure and simple this: they ran out of money, spent it on something else, or

the

lawyers got it, but it ain't in the bank account, and they can't make the

payments.

If I was one of those people owed money I'd be at the local JP's office right

now filing a small claims action for it, and getting a judgment. Judgment

creditors are ahead of the others in bankruptcy court, and this guy being a

doctor, sooner or later you'll get paid.

Forget the Attorney General.

about it. The Valley has had it's share of rubber checks from EMS providers.

Apparently the AG advised them that not paying employees would fall under a

fraud investigation since the providers are paid from state and federal funds.

And last I heard they were investigating complaints like these. Also there has

been an increase in PDs investigating these cases too as theft of service. We

argued that it was a civil matter, but they insisted it was a form of theft of

service. The problem is not that bad anymore. It still happens, but not that

often.

I would actually argue that this is one of cases where it's both a civil and

criminal act.? Theft of service actually does apply to this case.?? I'm just

trying to figure out how fraud applies, that's all.

It may take the prospect of being Bubba's roommate in Huntsville for some of

these shady EMS managers to actually not kite paychecks.

I've prosecuted bad check cases before and never seen them filed as fraud

before.

Well like I said from what we were told since the EMS company recieves federal

and state funds for payment of service, he considers it fraud not to pay the

employees. Now he may just be doing this because of the increase in fraud cases

and sees this as another weapon in the fight between good and evil. Grin.

Not so fast to blame the " Managers " , very often it is not the manager but

rather the Owner.

I once worked for an outfit in PA that well shall we say had ties to a

certain type of figure that was well rather stereo typical of some fictitious

characters from a now off the air TV Drama seen on HBO.

At the time I was a worker bee type but was soon promoted to Dispatcher and

in this case that was the ONLY layer of middle management we had, I did the

schedule on my 3 - 11 shift of the next day for the regular transports and the

like. I also culled the monthly reports on the first weekend shift of every

month for the previous month. We averaged 125-150 scheduled jobs a day and

added on 15 -25 per day for non scheduled stiff so 200 per day was a high

average. I noticed at the very first time I did the monthly reports (based on

the

run sheets and the dispatch totals that we were never under 250-300 runs per

day.

Well math is not my strong suite but even an Aggie (which I am not) can see

the 2+2+2=12 syndrome is a bad thing. I stayed 5 maybe 6 months and found

greener less likely to get me cooked pastures, many years later when the fraud

stuff was hitting the fan one of the very first companies to get pinched was

you know who. No one in management was getting a dime but the owners al drove

Beamers.
