I remember when I was a kid and my mom thought I should be a nun, (quit laughing!!), anyway, she also thought my brother should be a priest, (believe me, THAT is funnier)...one of the comments that was made as an enticement? " You'll make really good money and not have to pay for your living...house, car, all living expenses are paid for...even your food...the only expense will be for you 'personal things " ....of course, that was the early 70's...I'm sure it was a fluke... Let's say an employee gets fired for repeated call-outs and verbally being rude to patients and families.? They make a call.? The government swoops in, seizes records, does an audit and finds some irregularities so they put the agency on pre-payment review.? The agency has a 60 or 70% m-care payer mix.? They go out of business,?75 people are unemployed.? The owner, who was trying to run a responsible business is smeared, and when it is all over, 3 years later, they are able to show there were no irregularities, no fines were levied, but how does the damage get rectified? Andy is absolutely correct.? We ALL have to be extremely diligent.? You don't have to know you are violating CMS rules...the statute states " if you should have known " .? " Really....and lawyers? So based upon the line of work someone has, they can't have nice things...then why get all up in arms about paramedic wages? A paramedic cries they don't get paid enough but has two brand new cars in the drive way in front of their house they own...must be something wrong there huh? But if they have ANY assets you might be able to get them. Another technique is for every employee to file a separate suit against them for back wages up to the jurisdictional level of the Justice Court. That can be done without a lawyer. Hit them with several hundred suits that they have to either defend or have default judgments. Once a judgment is final, it can be abstracted and filed, and it latches onto any property they have. They couldn't sell a house, for example without paying the judgment. Oh, and beware of preachers. Mother they ain't. Scumbags SOME of them are. I go by the " car test. Is it, in your experience, that the government " swoops in " on one complaint? I am under the impression that when these raids are made, they are done under a search warrant. It requires a showing of probable cause to a magistrate in order to get a search warrant. So at least there is probable cause to get a search warrant before a raid. The U S Attorney evaluates each case in terms of a number of criteria. Failure to prosecute does not necessarily equal exoneration. Right now I'm told that the USA will not take a case that involves less than $1 million in fraud. That's why some owners are incorporating multiple companies, running them under the same name, but spreading out the billings to keep them under the $1 million figure. Also, the USA can decline prosecution for a number of other reasons. So one must be careful what conclusions to draw. That said, it is well known that an exoneration lacks media sex appeal, and doesn't merit page one coverage. That's wrong, but that's life in the big city. There is no doubt that there are some unscrupulous prosecutors out there (See: Nifong). There are also unscrupulous investigators, but I have not seen evidence of that in the actions of the task forces that are now operating in Texas. There are multiple agencies involved, including FBI, IRS, CMS, DSHS, and the Attorney General of Texas. It's hard for me to believe there is a conspiracy to ruin honest business people, but stranger things have happened, I suppose. Miscarriages of justice happen, sadly. I believe that most investigators and prosecutors try scrupulously to maintain fairness. It takes far too long for these cases to be resolved, granted. Sometimes the wheels of justice turn agonizingly slowly. As a lawyer, it hurts me deeply ever to see an unfounded prosecution or someone's life ruined for no reason. If that happened to your friend, there should be a way to make him whole. Unfortunately, Congress has not seen fit to set up such a program. The owner was exonerated...of course he was financially damaged, his company was out of business, his reputation was destroyed in the community in which he had been a business leader and the 40 or 50 people he had working for him were cast off into the wind... So, yeah...he was exonerated and never paid a fine or spent a day in jail...but 18 months later it really didn't matter.? The case I mentioned earlier is one...in addition, in a previous life, I have been a part of a company that was audited by HCFA in the early 90's and was placed on pre-payment review.? The methods used are ridiculous and like I said before, puts the agency as GUILTY until they prove their innocence.? I realize there is a difference between innocent and not prosecuted...believe me.? BUT that doesn't give us the right to jump to conclusions about the character or motives of those who are put under the spot light.? The problem with the methods of investigation that you described below is that it won't catch the bad guys attempting to make a profit illegitimately...but it does catch good, long standing companies who make mistakes. I would bet there isn't an agency represented on this list serve that if their claims were reviewed in a CMS audit or investigation by the US Attorney's office wouldn't be found to have wrongly billed CMS or been wrongly paid by CMS and it wasn't caught.? The bigger the agency the more likely it is a significant number.? This is the whole problem....and now folks are talking about the federal government taking care of all healthcare....nice.... Anyway, for fun, if you see a small agency violating CMS rules and regs (drive around Houston for a couple hours and you will probably see it)...call CMS and report it.? Better yet tell them you are from " Agency X " (insert any large transport agency for X) and wait for them to tell you they don't care about the 2 or 3 trip a day guy....they are going after the big fish....the problem....the big fish aren't the ones purposefully attempting to defraud the government....so again negative reinforcement for doing the right thing....aaaarrrrggghhhhh!!!!!
