I have a friend that was employed by a service and it has been over three weeks and he still has not recieved a paycheck. He worked for like three days and was told it would be in the mail. Slow pay (failure to dispense payroll on scheduled dates) equates to ‘no pay’. I trust he found another company to work for? They will handle it but it just takes a while. I had a company do me the same way once and the sad part is that the state will only collect straight time pay (You can't claim OT, holiday or other pay) I also had to supply proof of my hourly wage and that kind of stuff. It can be a good thing though as it can weed out a company who has bad business practices. In my case, the state discovered several other employees were having the same problem I was with this company and in the end they confiscated 2 ambulances and sold them at auction to pay us off. In the end the owner and his son are doing 45 years each on Medicare fraud. I filed a complaint against the provider, but by the time they started their investigation, the company was closing and filing for bankruptcey, so there was nothing that they could do about it. I told her that I have a really good attorney and just file liens against the buisness. I wish there was a place to list these types of people so others would know before they get burned. It will cost you a few buck to have the constable serve them with papers, but you'll probably get paid. If they decide to contest it, which they probably won't, you have a good chance of winning. If they don't contest it, you take a default judgment against them and then use it to collect. Sue not only the company but the individuals who run it. Sue the supervisor, et cetera. Either they deal with it or they get a judgment against them. You can have lots of fun with that. Just wait till they try to buy a car or a house. I left a company after six months and I was one of the lucky few who didn't get $%^ & *(@ when, at 2a.m in the morning, they woke the crews up and said " WE'RE CLOSED FOR BUSINESS! " This was a 911 private service(city contract) and they already had made plans a week in advance to have coverage provided by another service in the city when they pulled this stunt. He probably has 400 bucks owed him. Find a lawyer willing to take that case and I'll sing at your wedding. The only hope is the labor board, and that is a slim hope. Why do people still take these jobs? Can't you tell just by the interview what kind of service they are? Why are people willing to work for those wages and that kind of people? I did book keeping for a compnay that went out of buisness and partly because they are harder to get money from than the private indiviual. My attorney is my " friend " and he is willing to file liens against the owner and the company. There are run sheets that he filled out so it would be hard to say he wasn't there. I think there should be a list where you can post these kind of people so others will know and maybe other companies will not attempt this. As for the part about bankruptcy....most of the time employee salaries are not covered. The TWC is very good for getting you paid...they just take, like any other government agency, their sweet time and as I said before any OT/holiday pay will not be collected. They only will collect straight time no time and a half. In my case, I was a newby fresh out of the Navy and wasn't familiar to the seedy side of the EMS world. I took a job with this company and it paid good at $10.00 per hour with OT and a 72 hour 3 day work week. I was supposed to get time and a half for all over 40 but TWC would only collect straight time. I was owed nearly 3 weeks worth but only got to collect 216 hours straight time. As long as this person doesn't rely on this money for survival he should be ok...He might get it in time for last minute Christmas shopping. Again I don't believe salaries are covered under bankruptcy but if you name the owners, supervisors and managers in a suit and get the judgement it will be hard for them to change the company name and resume business operations which happens all too often these days.
