Does anyone know of any EMS system that has its own in-house counsel? In

the alternative, what arrangements does your EMS agency have for legal counsel?

I have served as an expert witness for several big city operations. While

not an attorney, I can tell you that the private defense firms mount a much

better defense than any city attorney I have dealt with. Medical malpractice

is among the more complicated areas of law and the attorney should be

familiar with health care. His or her knowledge of the zoning laws does

little to help the defendant EMT or city.

I can tell you this, most City Attorney's are the othersides best asset

(i.e. they generally are not capable of doing other types of law practice so

they are city attorneys)

I think what Wes was asking was about " in-house legal counsel, " not the

services of the City Attorney or County Attorney. These guys and gals

typically

don't know a Band-Aid from a traction splint and can often either give scant

attention to EMS questions or give poor advice.

I know that in my travels doing the HIPAA seminars (I did 56 eight hour

seminars in 2003) I found that the city and county attorneys either knew nothing

about it, cared nothing about it, or has asked some hospital person about it and

generally got it wrong.

So what I believe Wes is asking is, who has an in-house attorney separate

from the city or county legal departments.

Of course the giants like AMR and R/M and probably Acadian do. ETMC EMS

uses a private firm, IIRC.

The insurance carriers use private defense firms. However, they may or may

not know much about EMS. Typically they're the same ones who represent

doctors and hospitals and the issues can be quite different.

I have done lots of consulting with those firms and generally assist them in

formulating interrogatories and deposition questions.

Many of them don't know what EMS standard of care is. Lots of them have

nurses on staff and they rely on them for backup, sometimes to their detriment.

That being said, I agree with that they are far better than city

attorneys or county attorneys in defending cases against EMS.

The plaintiffs' attorneys may be very knowledgeable or clueless. I have

told lots of plaintiffs' attorneys that they didn't have a case, when they

thought they did.

No attorney should get involved in an EMS case without consulting with an

expert like or one of the rest of us who do this.

Yes true but you are also describing a few EMS Managers I know.

not just the giants. The small (80 person) firm I worked for in NJ made a

point to hire a business attorney that was an active EMT as well as a

Firefighter even though his office was in another county. We knew his JD and

background was sound but we wanted a person that was aware of the nature of the

animal

we were.

Yes Gene, we have a legal department that covers all possible aspects of

legal involvement, not just litigation defense.

even though I knew that ignorance was the correct answer, I forgot I was an EMS

Manager and was on the hit list as such.
