You have a minor child that has a seizure disorder. The child has a witnessed grand mal seizure w/ a hx of break through seizures. The child has been taking his meds as prescribed. The parent/guardian of the child does not wish for the child to be transported to the E.R. for evaluation. The parent/guardian states that they will take the child to their physician 'soon'. The question that has been posed by someone is: Can the parent/guardian be held criminally negligent if the child has another seizure and is injured or goes into status epilepticus because the parent/guardian refused medical care?
