Dr. Krin,

When writing my post I assumed that the proper legal proceedings would take

place including sound legal defense, an impartial jury and all the requisite

other components. To be more clear, after all of the above, if this young man is

found responsible then which of the two scenarios is more likely? I would like

to say that I believe a request to change the venue would only serve to irritate

the judge.

On a side note, as a former cop I have first hand experience in how the

judicial system operates and believe that, in theory, our system is a sound one.

In practice, however, is where we break down. But that is another thread.

Finally, let us remember that said young suspect has allegedly confessed his

role in the incident. I can only assume that this was done of his own free will,

without coercion, and will be fully admissable as evidence at trial. In fact, in

his defense, it could be used to show remorse. I'm as objective a person as can

be found but his admission starts to change the color of the landscape just a

bit. That is hard to argue.

ck: I agree with you in that. While 'paying one's debt to society and

returning to the arms of society' is nice in principle, a good argument can be

made

that the system is broken, at least partially due to the cost of 'The War on

[some] Drugs,' and that many criminals come out of their prison terms worse

goblins than they went in. I'm also less than sanguine that this kid will end

up in a program that will assist him in understanding his personal problems

and controlling them, much less a program that will actually make him

understand that he's got to be housebroken in order to freely circulate in

modern

ck: I've had my own share of experience with the system, partially as a

Deputy Coroner and POST certified reserve Deputy, and partially as an expert

witness for a couple of the local judges and lawyers when I was in clinical

practice. If there is ANY question about the perp's sanity, a good defense

lawyer

can spin his 'alleged confession' as obtained 'under severe duress while this

sterling young man was being deprived of his right to counsel', and manage

to get a jury to swallow that whole cloth (and do so even when the prosecutor

documents that the defense lawyer had been present during the interview and

assisted the boy in writing up the statement!). Probably, the good folks of

Tarrant County are more sophisticated than the mostly rural folks from

Louisiana that I've spent almost 20 years working with, but I was in the POST

class

as the former football star was tried for the murder of his ex wife and her

bf...and we dissected much of that in detail, including the mistakes of the

prosecutors and police evidence handlers.

I've also seen some recent reaction on a couple of other groups where the

consensus seemed to be pushing the limits of our Constitution, so maybe I'm a

bit more sensitized to the factors right now...

In any case, if the confession holds up, and the judge does his/her job

properly, I hope that the young perp does time to fit the crime AND makes

appropriate restitution to the man he egregiously injured.

My patient care is extremely objective, my personal opinions? Perhaps

not so objective, but then again, they don't have to be either.:-)

Im glad that the Paramedic Did not get hurt more severe or worse its to bad that

young man had to have been that stupid to have done that! That was a dumb ass

mistake The sad part is the lives he was putting in jeopardy to take his

frustration out on the other poor citizens of the Community I hope that he gets

his ass sent to jail for quite awhile so he can see what its like to be the one

going through crap, If the Paramedic who got hurt ever reads this I am glad Sir

that you did not get hurt anymore than you did I hope that you make a full

recovery You Paramedics do a great job helping other people and doing your

awesome skills Just to get a pay back like that its not right nor fair and I

hope they give him the Maxim sentence instead of just giving him a pat on the

back! God Bless and stay safe and good luck on your quick and swift recovery

The 'Castle Doctrine' is in the Texas Legislature also & most likely will

pass. As Missouri's & several other states similar law will prevent criminal

prosecution or civil suits in a self defense situation.

Hey folks,

TODAY is my first day back at work since the accident!!!!

I first wanted to say thank you for including me in all of your

thoughts and prayers during this recent hardship. Secondly, I am

also thankfull that everything turned out alot better than it could

have. One small move or one small change in the situation, and I

could have easily been killed. I am thankful that my wife did not

have to be contacted to advise her that her husband that the father

of her children had been killed. OK, now that is all of the mushy

stuff.

As time goes on, I find myself becoming more and more sympathetic

toward this " thug " and the mistake that he made. I am still very

frustrated with the whole situation, but the worst thing that came

out of all of this is one hell of a scar (and a little pain,

fractured skull, you know...no big deal). Things could have been

very different, and those of you that know me understand my true

feelings in regards to the punishment of this young man upon his

conviction.

Once again, thanks for everything. You don't always realize, and

sometimes take for granted, the amount of caring people that are in

our profession. But, isn't that why we do what we do???
