Guest guest Posted February 21, 2007 Report Share Posted February 21, 2007 I worked in a position for a large manufacturing company a few years back and worked both TWC (unemployment) TWCC (injury) cases on a daily basis. Of course this was prior to HIPAA, but we still had issues related to privacy and confidentiality. I am not an attorney, but here's my take on the subject as I understand it. Both TWC and TWCC investigations are legal proceedings and therefore would constitute " Mandatory Reporting " in my mind. There is also language about releasing the minimal information necessary to complete the investigation. I think this case is a slippery slope, but there is probably standing for the release of information. Why not just black out any PHI on the report before presenting it?
