So now that the elections are over and we are about to start a new Texas

Legislative session what are the topics that will possibly be brought up for

Texas EMS?

What is EMSAT or any other group doing to help with the session just around

the corner?

Are we still concerned with making a separate board for EMS?

What new laws to help EMS are we hoping for?

Inquiring minds want to know.

I'll bite...I would like to see legislation that would allow Counties to

regulate EMS within their borders...Certificate of Need, ESD, do

nothing....their choice...BUT give them the CAPACITY to regulate EMS...would be

HUGE for EMS in Texas...and a great baby step to better overall EMS regulation

and control across the state.

PS: Another one...like just about every other state regulated profession...I

would like to see ALL of our fees we pay to DSHS each year ALL go to DSHS

without a reduction in the General Revenue Funds they currently receive....

Ok Dudley I'll bite also. The state should not set guidelines on how counties

should regulate EMS providers in their counties, this should be a county issue

and not a state issue. I think that if the state does this, it would fringe on

free enterprise. This would mean that the big providers could monopolize one

area and not allow any competition.

I know how it affects EMS as I fired 2 crews (4 Basics) for just this exact

offense and won in arbitration when one of the members of the Crew took my to

task with the New Jersey unemployment compensation system.

It was one of those " I'm fighting this on principle " issues with both me and

the bosses of the Service I worked for at the time. At one point I asked the

arbitrator " how would you feel if you sat at that light and saw that

ambulance then had a wreck and it was the same ambulance that came for you? " In

end I prevailed.

That said, and going back to what Wes said about the lower form of

government being able to trump the higher form of government (in general terms)

in the

case of regulating " services " is the problem here in Texas not more to the

" larger issue " of the fact that as I understand it a " county " can't make an

ordinance?

You and I are preaching the same arguement...I do not favor the state REQUIRING

or telling counties how to do it...but right now Counties cannot do anything to

regulate it. Cities can pass ordinances....but Counties can't....counties need

the ability to regulate it locally to prevent " out of control " issues from

continuing to occur.

I'm overall a believer in the free market, but the market operates on the

presumption that the consumer has perfect information. Barring such

information, there is a reasonable need (in the interest of public protection)

for there to be standards for ambulance services, whether 911 or transfer.

Typically, the law allows for a lower level of government to set standards that

exceed a higher government's levels. Thus, a city's ambulance ordinance may be

more stringent than a state regulation.

In short, I believe that your right to make easy money ceases when it comes to

the safety and health of patients. If you don't believe this, look at some of

the advertisements we see on here for ambulance services in Houston...

Would those be the same ones you see with their units outside of Hooters and

eating inside in uniform. You my wife insist that all the girls inside run

around with their boobies hanging out. I wonder how many others in the public

think the same way. I also wonder how this affects their image of EMS.

Danny,

You pose a good question about what will be posed in the legislature that

will affect EMS. Unfortunately, we don't often know until a bill is actually

filed. We maintain a legislative liaison to help keep track on these issues

that will affect EMS.

EMSAT polled our members back in January to find out what they felt the

issues were. The two main areas they voiced were EMS Commission and Essential

Service. We are pleased that GETAC has formed the EMS and Trauma Regulatory

Task Force and feel that this is a step forward. More information on this can
