What is EMSAT or any other group doing to help with the session just around the corner? Are we still concerned with making a separate board for EMS? What new laws to help EMS are we hoping for? Guest guest Posted November 13, 2006 Report Share Posted November 13, 2006 I'll bite...I would like to see legislation that would allow Counties to regulate EMS within their borders...Certificate of Need, ESD, do nothing....their choice...BUT give them the CAPACITY to regulate EMS...would be HUGE for EMS in Texas...and a great baby step to better overall EMS regulation and control across the state. Dudley PS: Another one...like just about every other state regulated profession...I would like to see ALL of our fees we pay to DSHS each year ALL go to DSHS without a reduction in the General Revenue Funds they currently receive.... The state should not set guidelines on how counties should regulate EMS providers in their counties, this should be a county issue and not a state issue. I think that if the state does this, it would fringe on free enterprise. This would mean that the big providers could monopolize one area and not allow any competition. Cities can pass ordinances....but Counties can't....counties need the ability to regulate it locally to prevent " out of control " issues from continuing to occur. Barring such information, there is a reasonable need (in the interest of public protection) for there to be standards for ambulance services, whether 911 or transfer. Typically, the law allows for a lower level of government to set standards that exceed a higher government's levels. Thus, a city's ambulance ordinance may be more stringent than a state regulation. In short, I believe that your right to make easy money ceases when it comes to the safety and health of patients. Unfortunately, we don't often know until a bill is actually filed. We maintain a legislative liaison to help keep track on these issues that will affect EMS. EMSAT polled our members back in January to find out what they felt the issues were. The two main areas they voiced were EMS Commission and Essential Service. We are pleased that GETAC has formed the EMS and Trauma Regulatory Task Force and feel that this is a step forward.
