Guest guest
I've been thinking about CE issues both for field providers and EMS managers. What legal issues would you be interested in learning more about and why? I was just thinking that since so much of what we do involves laws and/or regulations, it would be good to ask what you'd actually like to have some boring lawyer lecture to you about... <GRIN> -Wes
Guest guest
Wes, I have always thought that labor law courses would be beneficial. More specifically FMLA and other types of " leaves " . Legal training I've been thinking about CE issues both for field providers and EMS managers. What legal issues would you be interested in learning more about and why? Guest guest
What about reviews of cases that have gone through the legal system? Reviewing a judgment or appeals court opinion with an attorney, especially one who has experience in the field, would be very insightful. Most discussions of legal aspects in an EMS in-service usually involve; well I read that this is the law in an EMS text or an " EMS legal guide " so it must be the law. Any discussion of legal aspects without citing the specific statute is really useless. I have seen instructors lecture about legal aspects but the never seem to be able to quote a specific law, statute or ordinance to back up their examples. Guest guest
Sounds like a great idea, Alan. I'll be keeping my eyes open for any appellate opinions. Please pass along any you find as well. Guest guest
I second this... I read the TDCAA reviews for criminal case law pretty religiously... Guest guest
There are various filing services and jury verdict reporting services, but they cost a lot of money. Maybe a big firm like Vinson & Elkins would have them and allow one to browse their library from time to time. I don't know what the UT Law Library has, but it might be worth a look. Guest guest
How about ways to better make your documentation lawyer-proof? I'm in paramedic class now, and we're always talking about what NOT to put on your documentation, as it might turn you into instant lawyer fodder. -Joe Percer > > Sounds like a great idea, Alan. Guest guest
Is there a case reporting service for EMS legal cases? I know PWW out of Pennsylvania does some cases, but most of their focus seems to be on billing issues (which may be something many of us want/need to read about). But then again, I doubt there are ten law firms in the country that have a significant EMS client base. -Wes Legal training > > > > I've been thinking about CE issues both for field providers and EMS > managers. Guest guest
Wes; How about HIPPA and how it specifically relates to EMS (i.e. what to say, who can it be said to, what can be said). How about treatment of minors and legal notification of parents/guardians. Possibly a speak on documentation and how what is written may or may not be interpreted by an attorney in court? Just a few off the top of my head. ExLngHrn@... wrote: I've been thinking about CE issues both for field providers and EMS managers. Guest guest
Joe -- I'm curious, what do the instructors say not to put in? Are they telling you not to document certain findings? What defines lawyer fodder in their view? -Wes Legal training > > > > I've been thinking about CE issues both for field providers and EMS > managers. Guest guest
Well not so much to not document findings, but things to avoid writing, such as PMS... They say we should go ahead and write out that the patient has a good <insert pulse here>, motor function and sensation intact in each extremity. Also to avoid using abbreviations/acronyms you cannot recall quickly, like DCAP-BTLS, because you might make it easier for someone to discredit your PCR. I guess what I meant I would be interested in is what sort of issue / questions / legal pitfalls would I face were I called to court... > > Joe -- I'm curious, what do the instructors say not to put in?
