OK, when employees of a certain non emergent service in South Texas

went to collect their pay on Friday instead of a check they were given

a memo from the owners instead. The memo was about how this service had

been involved in Medicare and Medicaid investigation for several months

and had been cleared of all possible charges but have received no

significant funds. Therefore all employees would just have to wait

until the check from Medicare was received before they themselves would

be paid. This is a 1200 + call a month service.

Now questions for the group:

1. Is this legal?

2. Are they entitled to additional funds?

3. What options do they have to collect pay?

4. Can they make their case to the public by naming this service and if

so what are the acceptable guidelines?

5. What would you do in this case?

It's sad that this happened at the start of the holiday season. Thanks

in advanced and may all have a happy and safe holiday....

I digress to the JD's among us

2. Are they entitled to additional funds?

I doubt that would be the case but you can always ask?

3. What options do they have to collect pay?

As I understand it limited the Feds will only help you get Minimum Wage and

I have no idea what Texas law does for this again I digress to the JD types.

4. Can they make their case to the public by naming this service and if so

what are the acceptable guidelines?

Of course the facts and only the facts are all that is acceptable but what

good does it do save for making a bad situation worse and maybe making the

grunts feel better, I doubt it would help anything.

5. What would you do in this case?

Seek gainful employment elsewhere even if I get paid in full. I always said

you get one missed paycheck and or bounced check in my book.

Go see a mean, nasty lawyer immediately. File against them in Small Claims

court and get on the way to getting a judgment against them. Judgment

creditors line up in front of general creditors in bankruptcy. Once you get a

judgment, you can see if they have any assets.

Should be easy enough to find one of them.
