It is the insurance company's responsibility to provide you with a replacement vehicle that meets your needs. Do not let them hold you to the $16/day restriction. When my van was in an accident, I needed a replacement VAN...not a car for the allowable $20/day... I have 4 kids and difficulty getting in and out of a car. If they were insuring a VAN...they must make arrangements for a replacement VAN. If it was a conversion VAN with ramp or lift, then they MUST cover the cost of a conversion van with ramp or lift. You may need to speak to the supervisor's, supervisor, but pursue this. Do not let them put you in a bind or inconvenience you. We have insurance for this reason. In addition, due to the type of vehicle you had and the fact that it can not be replaced quickly and easily off a dealer's lot, the insurance company MUST continue to cover the rental of an appropriate vehicle for a reasonable period of time....until a replacement is acquired AND you have settled on a fair market price on your totaled vehicle. Be sure to check out Blue Book, as well as 2-3 other sources for value of your vehicle. My van was 10 years old with 212, 000 miles on it. they wanted to give me about $1,000 for it when someone rear-ended me. Insurance paid for my rental VAN for 6 weeks while I looked around for a replacement that would accomadate my needs and also while we "discussed" via phone and letters the amount I was willing to "settle for. Finally I got a check for $4,500. Van was hit on July 5th. Check was received on September 5th. New van was purchased on September 6th. Insurance company pays for rental vehicle until settlement and replacement. Feel free to e-mail me if you need any "super-support". I'm not mean or a B----h....I just do not like to see people intimidated or taken advantage of by corporations/businesses/etc. Besides...it's freezing here in Delaware and I need something to get heated-up over! I am glad that everyone is working together to get your new van to you quickly. I hope you can find something out to transport you scooter to and from school. I wish I had some ideas for you. Mypatient co-ordinator from the insurance company is a real go getting andwill push. I have lots of carrying people at work, so I am sure something will work out. With all the van stuff, I think I forgot to mention that I got my new wheelchair on Friday. It is still sitting where it was put when it was delivered. I am a bit afraid of it as this minute, but will have to move it today to get it out of the way. It is very comfortable and I do look forward to using it - once I get better at driving it. I am really going to like the tilt in space function. Guest guest Posted January 18, 2004 Report Share Posted January 18, 2004 I called the insurance oversite people in our capitol and they said that Michigan law did not provide for more than I am getting. Every state has a different state requirement for insurance agencies. My insurance also has a $400 maximum per accident for rental. I can continue my insurance payments to cover the rental insurance, so I am going to try to get them to pay up to the $400 limit. I have not paid for more than that. They are also being very good about not expecting me to clean it out and get my scooter out as fast as they would normally. This the second time in a couple of years that I hit a deer. The last time they paid for it, even though it should have been totaled, because of my need for the lift. I did check out the Blue Book and NADA for fair market value. They offered me more than those listed, plus tax and title transfer, plus money for the lift (not a ramp or chair lift, but one of the small crane type) that has needed repair for a long time.
