Wow! That is one HUGE mistake. Boy I don't know about a lawsuit. Its something

you would have to figure out. But I know I would be VERY mad about this as its

all of your private info.

HIPAA Act Violation - What would you do?

Hi Everyone! I have posted a couple times, but I read everyones posts

more than anything else. This site has helped me and my family so

much. Just to give a background on myself, I am 28 years old and was

diagnosed in March of this year. I had a bilateral Mastectomy in April

with expanders. I started Chemo on June 2nd 4 A/C and 4 Taxol (only 2

Taxol left to go :)) I am negative on the er and her2 so I only have

radiation left and should be good to go!

Anyway, last week I found out that my doctors office has not been

faxing the excuse notes for missing work to my hr department. So I

told my doctor and she said that she would take care of it and that my

office would have them by Monday. Monday comes along and come to find

out they faxed over my medical records! All 78 pages of it! My

pathology report from my surgery in April, every CT scan and PET scan

and MRI. Every blood test and nurses notes from Chemo! My HR

department said that this mistake is a college fund for my 3 year old

son. Whould you file a lawsuit?

i would atleast talk to an attourney about this to see where you stand. this

was uncalled for!

There is a BIG difference between a note for work and

having someone who shouldn't see your records see

them. I would contact a lawyer and see what they say.

having someone who shouldn't see your records see

them. I would contact a lawyer and see what they say.

also - HIPAA is VOLUMINOUS - the regulations are more

than a thousand pages long - threre are criminal

sanctions connected with violations, and treble

damages - you should talk with an attorney who is

knowledgeable about HIPAA (I only know HIPAA as it

relates to human subject research) - an attorney

specializing is health law would be able to help you.
