This might as well have been snail mail. I sent my request to AAMT

(undirected, so it is probably my fault) and got this yesterday. Thought I

would share it. I am still stymied though. When is our business finished

with our client. I had a client who was active in April and May and then I

did not hear any more until last month. What did he want: to reestablish

with me and for me to send him the last set of reports I sent. I

reestablished and sent them on but if I had followed the guidelines I would

have deleted all in June. (By the way, he still has not sent anything

else??? other than the payment for the resend)

I think what I would do is to discuss ahead of time not only how much but how

often the client will dictate. Every day? Every other day? Once a week? Then

if I didn't receive dictation when expected, I would contact my client to find

out what the situation is.

Your contract should state how long you will keep records. Make the date

effective not from X time that you haven't heard from client but for X time

after transcribed. The time period can be discussed during contract

negotiations. If you haven't done this, perhaps you could discuss this with

your clients now and revise the contract with terms that are mutually

satisfactory.

The bottom line, I think, is to not keep the records any longer than necessary.

I suspect the law will look at intent and business practices to see if folks are

playing 'loosey goosey' with patient records or if they *are* being maintained,

that there is a clearly defined agreement and good reason for the

transcriptionist to keep them for the agreed-upon time period and that you are

both in compliance with contract in terms of this. In other words, I don't

think there will be legal problems for a transcriptionist who keeps records X

months because the client has requested it as a backup system. What the law

would look with disfavor on would probably be something like Susy Q.

Transcriptionist and her unlocked drawer full of patient reports and reports on

her hard drive, CDs, floppies, etc., that were umpteen years old, etc. I think

if you show that you know exactly what you have (and where) and that you keep

records (in a confidential and safe manner) per your contract for X period of

time that you will be fine. Just my speculation here...

I think there might be 4 of us :-)

As a member, I was entitled to one free copy and took advantage of that.

I'm not sure I would have spent the money, but the document did at least

clear up some issues for me. I really don't think any of us will really

know everything we need to know about HIPAA until March, but that's only my

opinion.

Can somebody translate this for me?? PPC??? MTCC??? Thanks in advance.. I feel

sooo out of the loop.

By the way, I just have to say that I think it's awful that anyone should have

to pay anything for information regarding HIPAA. I said it before and I'll say

it again.. there should be an accounting to AAMT members as to where all this

money is going. Just my 2 cents.

Congratulations Chris!

They are planning to make Part II to be taken the same way that Part I is

and instant gratification or disappointment. I think that was the hardest

part for me was the waiting on Part II results.

That's good to hear. I'm also on fence about joining. Won't do it right now,

but will in future most likely. I plan on testing for CMT as well. Most likely

won't do that until next year. I have some studying up that I want to do and

figure that would be best after my youngest, now in kindergarten, is in school

full time. How did you find that test to be. Was it challenging, fun, did you

feel prepared?

Groups can be fun, as well as frustrating. I used to be member of German Shep

club, obedience club, now VP of pool league here. I like pool league best.

Coolest people, no back stabbing.

I sent for mine this morning. When they first offered it a couple of months

ago I sent for it and got a business associate agreement but not the HIPPA

for MTs. Will let you know when I see it.

Thanks. I will meet with my clients the first of the new year and come to

some kind of agreement. mentioned sending Memos once in a while which

shows them we are keeping up with things and that is what I will do

followed up by a meeting. Thanks again.

I work for a national also and I've been told NOT to remove patients' names from

reports, but it's my understanding that's the agreement between the client and

the national. In other words, the client does not want the patients' names

removed.

Does the HIPPA affect people who work for nationals? I use their computer

and I never print out reports with names.

I saw this misspelling of the acronym on a poster in the hospital attached

to a medical school the other day, so apparently it's a common

misconception. The acronym is HIPAA, for Health Information Portability

and Accountability Act.
