Elaine has deemed the Brainchild Ultra Sensitive to be legal, despite the small amount of xanthan gum. She announced this decision at the last DAN conference. As with anything, if your child isn't progressing well and you are using this product, you might consider switching to all purely legal (zero xanthan gum) supplements to see if that makes a difference.
