Terry,

I am writing to let you know what I have learnt about Disability. I am

not sure what parts are different depending on what state you live in, but

this is how things went in Kentucky; We were not able to hire a lawyer until

we had been turned down by SS. Once we received our denial letter, then we

could go to a lawyer and his fee would be 25% of back pay not to exceed

$2500. We did get the denial letter and took it to the lawyer and he said it

is procedure to first file a reconsideration. We were devastated. It had

taken so long for the denial letter and then the lawyer told us, " Now comes

the slow part. " We cried in his office because we were broke. Well, my

husband went into the hospital 2 weeks later and remained there for 70 days

with problems that I quickly reported to Social Security and we were approved

before he got out of the hospital. Social Security told us that the lawyer

would get his fee even though we never went to court, but the lawyer only

took $33 for his out-of-pocket expenses.

My best advise would be that if you have a good relationship with your DR.

ask him/her to help you with a letter stating your inability to work.

I know it is a pain to go through, but it really doesn't hurt to try and I

will pray that it all goes well for you.

In response to your very good suggestion; I always THOUGHT I had

a good

Terry, try not to get to impatient with your doctor. They all get

weird when it comes to narcotics because the DEA is constantly coming

down on the them and they could lose their licenses. Besides, you DO

need him and his confirmation that you are so ill for Social

Security's sake. He's the one that makes it or breaks it. So,

instead of calling the office, make a trip there. It'll make it a

little less frustrating for everyone. I learned that one that hard

way! (I'm a very impatient person!)
