Copyright really doesn't apply and just because you type in a recipe to put on your site doesn't give you some special right to it, especially if you didn't actually take the time to create the whole thing from scratch. Actually, I'd be more concerned if I were the owner of the mizfrogspad diet site -- there's some fairly blatant violations on that site, especially since it claims to be trying to get away from SBD and go to SEL. She must have had some legal problems with SB since she specifically mentions the Fair Use law and then slams Dr Agatston in her 'book review.' I'm guessing she posted the Phase 1 and Phase 2 foods lists, since she specifically states that she is now posting HER food lists for Phase 1 and 2. Assuming the site actually intends to take things to the extent of creating a new diet, it would clearly be a derivative work and she'd be in jeopardy of civil action against her efforts. Yeah, I was looking through the site earlier today. All I can say is I hope she has a good attorney -- Agatston's people will be all over her, especially with some of the changes she's made now. I believe if you use someone's name then you have got yourself a problem.. and this list does refer to itself as South-Beach-Diet... and also lists Dr A's info at the bottom of it which can be misleading as if he endorses this list.. which he does not..
