RE: Recipes from my site

I think most people get recipes from other recipe groups, and they

probably don't have any source on them at that point for the people to

copy down. I've never seen any source listed on any of the recipes I

have.

<Whistles> Kinda tough to really claim much right to or ownership of

recipes. Copyright really doesn't apply and just because you type in a

recipe to put on your site doesn't give you some special right to it,

especially if you didn't actually take the time to create the whole thing

from scratch. Besides, if you had actually taken any time to participate in

this forum, you'd have long since known that your site is in fact discussed

here from time to time.

First amendment protects the discussions of this and just about any other

forum. They'd have a hard time putting together a law suit. Actually, I'd

be more concerned if I were the owner of the mizfrogspad diet site --

there's some fairly blatant violations on that site, especially since it

claims to be trying to get away from SBD and go to SEL. Should prove

interesting to see.

I'm guessing you received cease and desist letter from the folks at the SBD,

eh?

Can you tell me how you know they came from your site? I have seen all kinds of recipes on many different sites, who is to say they have "the rights" to it?

I put in a lot of hard work and long hours putting these together and getting them on my site.And the recipes here are not the latest on my site, as I've made changes and continue to do so on an ongoing basis.And a word to the wise..... the lawyers will be closing down forums like this and other sites that are SBD sites and forums, as they are "illegal." I visited her site. She must have had some legal problems with SB since she specifically mentions the Fair Use law and then slams Dr Agatston in her 'book review.' I'm guessing she posted the Phase 1 and Phase 2 foods lists, since she specifically states that she is now posting HER food lists for Phase 1 and 2.

Assuming the site actually intends to take things to the extent of creating

a new diet, it would clearly be a derivative work and she'd be in jeopardy

of civil action against her efforts. I'm not an attorney though, so who

knows -- maybe she's done her back work. ;)

Yeah, I was looking through the site earlier today. All I can say is I hope

she has a good attorney -- Agatston's people will be all over her,

especially with some of the changes she's made now.

Just thought I would jump in here for a moment.. I

believe if you use someone's name then you have got

yourself a problem.. and this list does refer to

itself as South-Beach-Diet... and also lists Dr A's

info at the bottom of it which can be misleading as if

he endorses this list.. which he does not..

Just hanging out at the beach and playing in the
