I'd like to add that I appreciate the work y'all are doing so much--but I think we need to make sure we are including ALL the kids. My son is left out of this picture because he was born in 1980, but he was still mercury poisoned. So can you work with the legislators to make sure those of us with older children also have recourse? Thanks so much for your help! Guest guest Posted April 4, 2003 Report Share Posted April 4, 2003 Barb: When the VICP went into effect in 1988, there was a " window " during which pre-1988 cases could file for injuries. Obviously, that window is now closed, so under the current law, those injured prior to 1988 can't file. In the current VICP legislation now being negotitated, there is a plan to allow a filing for any injury listed on the vaccine injury table without a statute of limitations and there is an alternative plan to only allow for injuries going back 10 years. Obviously, the former plan is preferrable. However, both plans depend on getting an injury listed on the table. Getting listed is a corrupt and dishonest process right now. Basically, getting listed is at the sole discretion of the Secretary of the Dept of Health & Human Services, and they have zero inclination to list anything and in fact have made concerted efforts to get injuries (backed by good science) de-listed.
