I am sorry, I don't know the entire story as to why Buster lives with you and not his mom, and why you have custody and are not able to make these sorts of decisions without her. She changed her mind but was out " boy chasing " and didn't have time for him, so I let him stay here. We took care of him until he was 35 months. Then she showed up with the police and claimed we kept him without authorization. So, we took her to court as he has these special needs. CPS didn't see anything wrong with how she was living or what she had done and they wanted out of the case. She had made one appointment for him and they figured she was living up to her obligation as a parent. Without a lawyer, we were pretty much helpless in court, as neither CPS nor Buster's lawyer would help us. She did not follow through on a lot of things and in Arizona you have 90 days to resolve a case like this. The appointment she made was for the 91st day. The fact that she lived in an apartment with maggots, etc, didn't bother them at all. Anyway, she decided that he could once again stay with us, while she supposedly gets her life together (again) and here we are. I told her last week that she didnt have to come to this appointment but I would need a power of attorney. " But I want to come. " Well, now, he doesn't get a dx until she does something. UGH. You might ask on your state autism list about lawyers who do pro bono work. Catholic Social Services and Easter Seals might also have some resources. Maybe someone would be able to help you? There really should be something you can do. I wish I knew more people with connections in Tucson.
