Guest guest Posted August 25, 2004 Report Share Posted August 25, 2004 This has nothing to do with deafness but I know there are people here that are brilliant with the IEP and SPED rules that can help me with some answers. I am looking for some help on an IEP issue and change in schedule without parental consent. My older son got in trouble and is supended from the bus, who knows how long. If anyone knows what " awhile " means let me know, ugh. He has bipolar disorder and has an IEP and BIP. My issue is that I can't findout how long he is off the bus and we are driving him to school and picking him up early because he was manic. They had mentioned that re arranging the schedule was possible so I could bring him in later and not have to drag my other child out 1.5 hours before his school opened. I told them I had to talk to my husband and see what we could work out. Today I go to get him for an appt and the behavior specialist pops in telling me that the schedule change is taken care of and starts tomorrow to bring him at 9 AM. School starts at 8:15. He will not be going to science class now and he has to be picked up at 1:30 PM. Which means he will miss another PM class (PE and Health) plus cirriculum assistance class. Now PLEASE TELL ME that they can't just do this without a meeting and my signature because I plan on taking him at the normal time. His psych and therapist said they can't do this, and I didn't think they could even if he did not have an IEP. I would imagine that it would depend on how the IEP is written. Are the 2 classes he would be missing written into the IEP, or the hours of school he will be going? If it were me and this happened to my son, and I took him in at the normal time anyway and they wouldn't let him attend, I would request an IEP meeting ASAP to review my son's IEP and BIP, because if something happened to get him kicked off the bus, the BIP (and/or IEP) must not be appropriate and needs to be changed. Anyway, if your son's IEP says he is to receive X amount of hours of general/mainstream/classroom instruction, then it takes the entire team to change this - and remember, you are supposed to be considered an equal team member (in theory at least - seldom in practice, but the IDEA tells us we are). Elaine, I just found this email in my collection from when I was a away and so I apologize for the late response. I would be in the superintentent's office demanding to know what " awhile " is and what the district's standards are for being suspended from the bus. Our district has written rules of behaviour and what the repercussions are. I'd also want all the details of the incident that lead to this suspension. I would want to know what other children were involoved and what their punishment has been. In my experience it takes at least 2 to fight and neither is completely innocent when the incident gets to be this serious. Was there an aide on the bus? Iffnot, why not? If things had been escalating and your child has know behavioral issues, there should have been an aide on that bus. As far as I know there cannot be changes made to his IEP without your input and consent. But I'm not sure this is automatically an IEP issue. Transportaion was never mentioned on our son's IEP so an incident like this would not have immediately involved his IEP. Is transportation discussed in his IEP? Perhaps you should be requesting a new IEP meeting to officially have an aide immediately placed on the bus. My question for you is whether his bi-polar status and the accompanying behavioral issues are acknowledged and addressed in the IEP. If so, then it is possible that the solution that should have been done was to put him onto what we call the " little bus. " Our district has several small buses that pick up kids with special needs. The district is obligued to provide transportation for these kids, but for many different reasons those kids can not handle a full size bus. As for having him come late and leave early, it sounds like they are just trying to make it easier on themselves. Missing classes is simply not okay. For a few kids in our district, they leave a few minutes early because it takes time to get the wheelchair lift process done and they ride on a regular sized bus. The child in the wheelchair is loaded first so that the driver and aide can be accomplishing only that task without the distraction of the other kids piling onto the bus.
