Hi Stella,

There is a law that you cannot be let go from your job because of having breast cancer. Contact the American Cancer Society and I am sure they can send you some literature. I will keep you in my prayers.

Hi everyone,I just joined the group and and after reading many messages, my heart aches for all of you, especially those who have had a much worse experience than I did. I should have joined sooner, your support is heart warming and I could have used it. I had a lumpectomy on 7/8/05, 1.8 cm, followed by CMF chemo just completed 12/29/05. Starting radiation this week for 33 sessions. If anyone of you who work, how did you get through the days and be cognitive and have energy? Before my second chemo I collapsed at work with fatigue and went on short term disability. Just started long term disability, per doctor recomendation, and just found out per phone conversation with my boss that I don't have my job to go back to and have to pay my health insurance through COBRA (you know how expensive that is). I feel like I'm being discriminated against. I am 59 and single and have no one to depend on.Thank you for any experiences you might share with me.Stella

Hello Stella, You definetly have a legal issue because they have to give your job to you when you go on disability. That is a Federal Law. Also, what kind of breast cancer did you have? I have invasive ductal carcinoma. I had a lumpectomy the tumor was about 1.5 cm but I did not have chemo. I just finished my 28 radiation treatments. I always worry why the doctors said I did not have to do chemo. Because I don't want it to come back. Stella,

Here is the url for the ACS page that discusses employment discrimination. I'm sorry you are dealing with that. My employer basically told me to go home and not come back until I was done and not to worry about my job. I wish all employers were like that.

Stella, what your boss did is illegal I believe. You need to find an EEO lawyer fast. I cannot remember the legal jargon but it is against labor laws to fire someone due to illness that prohibits them from going to work but I do know that it is against labor laws to fire someone due to illness as long as you are under a doctors care. DAMN this PISSES me OFF!!! I thought this kind of garbage behind us.

(the person that picked up the extra responsibilities that I could not handle was compensated the difference between what I made when I came back and what I used to make. They wanted me put something in writing to protect themselves from a future lawsuit. As soon as I mentioned contacting my attorney before signing anything they suddenly accepted a verbal statement from me, equivalent to "yes, this is acceptable to me, until the time which I can assume my old responsibilities and then receive the normal pay." This was perfectly acceptable to them and me.

We have an excellent human resource manager who is aware of all current state laws and she was only looking out for the company. She also looked out for me when I was on short-term. She did not let me check my e-mails from home because I could have been considered "working" and thus deemed ineligible for the std.

I encourage you to check with your local state representative or check out the laws that apply to your state on the internet. You definitely have the right to have your job or an equivalent when you return. I am not positive about the health insurance issued. Stand up for your rights, do not let them bully you!!!! Good Luck

Thank you for all the input. It helps me to be strong in my resolve to go

forward in actions that I have to take. I'm reallydown emotinally and need all

the coaxing to keep me on track. I cannot afford to lose my job and will fight

for it. It was a long weekend with a holiday, so Tuesday I will be making more

phone calls to inquire about my rights. Will keep you posted in hopes that it

will help someone else before they get to this point.

Note: forwarded message attached. I was working at the time I got breast cancer in 2002...I got chemo on Monday every 3 weeks for 8 times...Would be off work from Mon to Wed...and go back to work Thurs and Frid with a little stomach ache... after 4 chemos treatments it was also hard because I lost my Mom suddenly..then one day had to do an errand for work and it was warm that day and I had had chemo that week...and ended up with low grade fever and 5 days later in hospital for fever and low blood count...was in Hospital for 4 days...and learned my lesson to stay out of work a week when I got the chemo... I worked at a Community College in the Business Office taking tuition payments and sending out bills to students

who still owed on their tuition... and some days stood at the tuition window all day long... The girls in the office did not like the fact that I had to be out when I got my chemo...Meant that some of the girls had to do a little extra work...Take my place at the window taking tuition payments...They were the kind of girls that complained if they had a little extra work to do...The least they could do they would... No compassion for me being sick and loosing my Mom... They just kept saying I was not doing my job... I kept my filing and work up to date all the time... So I understand about working and going to chemo... When I had radiation I went on my lunch hour because the New Cancer Building was just up the

street near the Hospital... They did not like it that I had to change my lunch hour to fit the radiation treatment in...But if it was someone else in the office that was sick they would have helped that person... I was the guinea pig in the office because I was single and had no children...They thought I did not have a life except working...I worked alot of overtime... I kept working till 2004 when I retired after working at the same Community College for 32 yrs and 7 months...They were making it rough for me..Only once did I yell at one of the girls in the office because she said you are making the other girls work harder becaue you have cancer...That made me real mad... I was the guinea pig in the office because I was single and had no children...They thought I did not have a life except working...I worked alot of overtime... I kept working till 2004 when I retired after working at the same Community College for 32 yrs and 7 months...They were making it rough for me..Only once did I yell at one of the girls in the office because she said you are making the other girls work harder becaue you have cancer...That made me real mad... That is not right that you dont have your job when you get better... Hope you get

Thank you for all the input. It helps me to be strong in my resolve to go forward in actions that I have to take. I'm reallydown emotinally and need all the coaxing to keep me on track. I cannot afford to lose my job and will fight for it. It was a long weekend with a holiday, so Tuesday I will be making more phone calls to inquire about my rights. Will keep you posted in hopes that it will help someone else before they get to this point.

It is cruel. It's one of our societal ills, the bottom dollar is the most important thing and the I've got mine, screw everyone else attitude.

i just read what you wrote about your job and ins. exspense,just so you know depending on the state you live in,regardless of ins.or income or assets.there are programs that pay your insurance and all medical exspenses.it's through the state medical program or contact the american cancer assoc. explain your situation an the exspenses.they will help tou financially. i live in pa. and my ins.wouldn't cover everything i needed to have done,i was told to apply for the access card for extra coverage.i have not recieved a bill since,my total billing to date for medical care dr.visits, medicine, & hospital stays has totalled over $470.000.00 .my personal medical ins.covered only 60% of that bill.an would not cover my medication at all.i swallowed my pride and went on welfare so i could take care of my 4 kids,pay bills an keep some form of norm for my childrens sake. it's messed up how i found out i had br.cancer,i went for a exam

then a mamogram then was told i had some extremly dark shadows around both breasts an i needed to go for a biopcy.i went had the testes done got the reports back an was told it was nothing i was perfectly healthy,(the dr.had my test results in front of him) but i needed to see a srgean just the same about these dark shadows,i figured i was healthy i did't need to go right away.i set up the appt.about a month later,went and was told "you have cancer in both breasts" i went thru another very painfull biopcy.just to be sure.keeping in mind my private phy.told me i was perfectly healthy i had no cancer. i went thru a double mestectomy and reconstructive surgery.i'm still going thru some of my reconstruction and am almost done.all my new tests show no cancer and it's been almost 18 months now,i'm back to work,i had to start at the bottom though,but at least my job was there. needless to say i changed doctors an now have very careing doctor. in the last

18 months i've had alot go on in my life,i was diognosed w/ cancer,my mom was diognosed w/cancer,she passed away in july 05. she lived only 8 monthes after finding out. my attitude toward cancer was i have cancer but i will beat it it does not have me an will not keep me. you have to keep a positive mind on your condition if you don't it will win. the best of luck to you i hope you win. but keep in mind you have people who do pray for you. check into your state programs for financial help and find a good Medical Attorney about your job,what your boss did was very

It's a small community health center where I've been the admin assit

for almost 7 years. I don't know where it will get me, but I'm

going to fight to get my position back and return to work asap after

I get dr to release me back to work. I just don't have a choice.

Wow, you have some story about your cancer. Glad that you are doing well now

and are back to work. Are you single with 4 children? That's a task in itself.

Thank you for your encouragement and I am building the positive attitude. It's

been quite a wake-up call.

Hello,

Just an update...Thank you for the info you all sent me and I looked

into some already and will be looking into the others. At the moment

I'm trying to get my job back and I'll know for sure probably today

their decision. It doesn't look good though. Then I will proceed to

plan B. It makes me so angry at the way they are handling my

situation that they didn't discuss anything with me before I started

LTD, 12/26.

Started radiation the 17th. Have 31 more to go. I just wonder when

I'll have a life back.
