They can. They may say they can't/haven't/etc. but that is not true. Also, be careful about unilateral placement. I didn't understand that if they " checked the box " that said unilateral parent placement that I lost all of my rights provided by IDEA. Good luck, Color me naive, but I've never heard of this box and never seen it. Given the trouble our school district gave us about providing services for Ian, I'm sure if there was a magic box to check to get rid of us, our district would have tried it. Please tell me more about this! Thanks -- Jill

Good luck, Color me naive, but I've never heard of this box and never seen it. I was in Arkansas at the time and they still use 5 part paper for their IEP's. So it really was a box they checked. My new school district is " starting " a hearing-impaired program they insist will be able to meet my daughter's needs, although nothing is in place and it is the end of the school year. They are trying to force us to use it and not continue with the private oral school that they paid for this year. I feel they are trying to force me say we will use " unilateral private placement " and pay ourselves, saving them money. It is in Section 1412 State Eligibility. Maybe someone with a legal background will add more. I was naive when I started my journey into special education 4.5 years ago.
