Just thought I'd send out this ... it identifies many of the kinds of

services that our kids need. These are types of services that have been itemized

within the definitions. As can be easily seen from this list that whatever our

kids might need, it can be provided by the school district under ADA/IDEA/504.

It's only a matter of demonstarting and documenting need.

SEC. 602. DEFINITIONS.

(22) RELATED SERVICES- The term 'related services' means transportation, and

such developmental, corrective, and other supportive services (including

speech-language pathology and audiology services, psychological services,

physical

and occupational therapy, recreation, including therapeutic recreation, social

work services, counseling services, including rehabilitation counseling,

orientation and mobility services, and medical services, except that such

medical

services shall be for diagnostic and evaluation purposes only) as may be

required to assist a child with a disability to benefit from special education,

and

includes the early identification and assessment of disabling conditions in

children.

(29) SUPPLEMENTARY AIDS AND SERVICES- The term 'supplementary aids and

services' means, aids, services, and other supports that are provided in regular

education classes or other education-related settings to enable children with

disabilities to be educated with nondisabled children to the maximum extent

appropriate in accordance with section 612(a)(5).

SEC. 605. ACQUISITION OF EQUIPMENT; CONSTRUCTION OR ALTERATION OF FACILITIES.

(a) IN GENERAL- If the Secretary determines that a program authorized under

this Act would be improved by permitting program funds to be used to acquire

appropriate equipment, or to construct new facilities or alter existing

facilities, the Secretary is authorized to allow the use of those funds for

those

purposes.

I'm including the following (Sec 636) because of a question I remembered

about services provided to the families and not just to the kids. This comes

from

the section on early intervention. This can easily be interpreted to mean that

parents could be taught to sign or whatever they need to learn to communicate

with their D/HOH child. Also, the last paragraph clearly does not limit the

frequency of evaluations. Certainly not limiting them to once a year as some

ditstrict told someone on this list. I cannot remember who ... but here it is.

SEC. 636. INDIVIDUALIZED FAMILY SERVICE PLAN.

(a) ASSESSMENT AND PROGRAM DEVELOPMENT- A statewide system described in

section 633 shall provide, at a minimum, for each infant or toddler with a

disability, and the infant's or toddler's family, to receive --

(1) a multidisciplinary assessment of the unique strengths and needs of the

infant or toddler and the identification of services appropriate to meet such

needs;

(2) a family-directed assessment of the resources, priorities, and concerns

of the family and the identification of the supports and services necessary to

enhance the family's capacity to meet the developmental needs of the infant or

toddler; and

(3) a written individualized family service plan developed by a

multidisciplinary team, including the parents, as required by subsection (e).

(B) PERIODIC REVIEW- The individualized family service plan shall be

evaluated once a year and the family shall be provided a review of the plan at

6-month

intervals (or more often where appropriate based on infant or toddler and

family needs).
