It is. It happens that way here in New York. However, the ironic twist to

receiving those services at a private school is that you have to go through the

evaluations and whole IEP process with the local district. The needed services

have to be included in the child's IEP, which is determined by the usual

process we've all gone through. -- Jill

If the FM is in her IEP and the district cannot provide an appropriate

placement within their system, then the FM should go with the cnild onto

whatever

placement is determined to be the appropriate LRE for her. The district cannot

hold that equipment hostage or refuse to provide it just because the child

needs to be placed in private school to meet her needs.

I don't believe it is legal to hold the equipment hostage in order to

convince you to place her in their school. If she needs the program at a private

school, she should be there along with her necessary equipment.

You'll need to have your own documentaiton supporting both the placement you

think is best and her need for the FM system. Denying either request can be

appealed.

We " unilaterally " placed in a private school this year and lost the

use of the FM system we'd had for three years. We knew it was coming,

though, as I'd been gearing up for this for some time. In our state, the

districts must offer a certain percentage of their funding for kids in

private placements but, as our very experienced and expensive attorney

advised us, the cost of placing some kids in alternative placements can eat

that percentage up quickly. In our case, our district has been required to

place two children with special needs in out-of-state schools (!) and what

they pay for those children more than fulfills their required percentage.

What was so ridiculous about all of this was that our district was paying in

excess of $15000.00 per year (plus the FM) for to attend his special

school for hearing impaired kids but when we asked for nothing else but the

now-used FM system, they wouldn't do it. The cost of getting an attorney to

fight it would have paid for 10 FM systems and so we paid out of pocket.

We could have asked for speech services to be provided (on public school

premises of course!) but the idea of pulling from school and driving

to a half-hour appointment once a week with someone who wasn't even

experienced with HI kids was not appealing. There was no way to get them to

do the driving. Get this: In OUR state it is actually ILLEGAL for a public

school bus to drive anywhere near to a private school for student

transportation!

The FM system is an assistive device to ensure your child has " equal access

to the academic cirriculum. " If the IEP team determines that the most

appropriate placement is in a private setting, the devices that s/he needs

to fulfull the requirements under IDEA and FAPE shouldn't change. If the

school is concerned about the well-being of the equipment, they should

designate an individual in the private school setting that is responsible to

ensure the FM is functioning properly, and is properly maintained and cared

for.

I would ask them where their priorities lay! Are they more concerned about

an FM system then your child's quality of education?!?!?!?

It amazes me too...but it's there. I've read the whole code myself, after

having been directed there by our attorney and several websites. It's

Washington state which, incidentally, it looks like we'll be leaving soon

anyway. :-)

My husband is from New Jersey where EVERY child is bused to school, no

matter which school it is. I know there are others. Apparently, those

legislators understand that education is more important than being

politically correct and that parents should have some say. My heart goes

out to the families who just can't afford the schools they'd really like and

they have to beg and plead and threaten to get the basics, however

inadequate. I have to admit that it felt really good when we were able to

tell the district " thanks for everything, but you're out of our lives, now! "

It was also a bit gratifying to know that pulling from the special

program made room, and the money available, for another child who needed it

more.

In VA as well. The public school bus may not enter private property. I

work at a private school on a busy road.

Last year one child had to be dropped off while the bus held up traffic. A

teacher/adult had to walk to the road to meet the bus every day.

Last year one child had to be dropped off while the bus held up traffic. A

teacher/adult had to walk to the road to meet the bus every day.

was actually across the street from the public high school and I asked if

they'd at least drive him to THAT campus since it was a district school and

I would meet them there. Bet you can guess what their answer was!
