As far as I know it is not illegal to tape someone it is just inadmissable

in court. just court not reviews hearings etc.

If a person is asked for their permission to tape a conversation and they

refuse it then becomes illegal.

Regardless of whether the tape was made with or without the permission of the

other party it is not admissable in court.

Just my two cents.

I get to deal with that question at work all the time.

yet? How strongly did your PCP defend his referral for WLS? I'm

designing a T-shirt to wear outside my insurance company's office just

in case they continue to drag their feet....I was vebally denied on May

you sound alot like me. I am fighting like crazy!!! Matter of fact, I

am sitting here combing through every Kaiser letter looking for reasons

to file formal complaints with them. Legally they have to have an

appeals hearing for VERY complaint put in writting......it may not get

me approved but it is great therapy for me!!!!!!!!!! Just knowing that

they will have to hire extra employees to keep up with my complaints is

theraputic!!!!!!!!

If I don't get my denial reversed, I am going to make sure they know my

name when the next request pops up!!!!!! I am also getting lots and

lots of documentation in play if I ever need it.

If you would like to chat about " strategies " both ethical and nonethical

(sorry Dr R but I am desperate!), please feel free to email me

personally anytime.....

The problem is that I may go broke mailing out all of this stuff!!!!!!!!

I am taking Dr R's lead and sending duplicates of every letter just in

case...............LOL

Hey Kathy.... were you ever able to tape record any conversations with

you ins. reps. or during their " hearing " that you attended? Have you

found anyone on OSSG who had the same insurance and the same medical

history? (I haven't joined OSSG because the e-mail box on webtv is

limited to 160 or so.) What about a meeting with the medical director

of the entire insurance company and all of your doctors (via phone where

you could also participate and tape!) Keep on fighting!

I have web too. You can sign on OSSG, and post asking for particular

info to be sent to you privately , then unsub. That is what I do when I

need info. good luck

You can record phone conversations as long as YOU are in the conversation.

This is ADMISSABLE evidence. But you CANNOT record someone else if YOU ARE

NOT in the conversation.

As far as I know, and I am not very knowledgeable in this area of law, it is

criminal under federal and under the law of most states to surreptitiously

record a conversation (i.e., to tape without the knowledge or consent of the

other party to the conversation). If you tell the person that you are going

to tape the conversation, they have the choice of consenting to the taping or

not talking. If they decide to talk, knowing they are being taped, the taped

conversation is probably admissible in court provided it meets the all ofthe

other requirements for admissibility.

Remember Lewinski's " friend " who taped their telephone conversations

without asking for consent? She was charged criminally in land under a

land law.

Note that what is illegal could vary from state to state, and if an

interstate call is involved, you have a choice of law question: what happens

if the laws are different in each state?

They are only illegal if the person on the other end has been advised of it

and says they don't want to be recorded. If they don't know or they say it's

okay it is not considered illegal.

It is illegal to record anyone without their permission. I had a friend at

work who, in a bluff, told administration that she had recorded a

conversation she had with them and they were ready to prosecute her.

That ought to raise some eyebrows and light a fire or two....especially if

you can get the media notified. It sounds like you would make a good

" person-to-person " episode on the news broadcasts.
