Pam: I want to hug you, but we won't get to see you on Friday, therefore

can't until November. . I've managed to hem 2-3 pairs of overalls but am

balking at doing more at 11:00. I cannot believe that this could be 's

last year with ya'll and might just cry and cry. Martha

Pam: Oops: if you're really serious, just double the hem. I doubt that we'll

have room in 's suitcase to bring the overalls with us, but I'll ship

them. I bet you never thought you'd be sewing at Perkins! Martha

I looked it up, it was easy to find, because we had to mark it in our

Partners in Policymaking class. The lawyer who presented was pretty clear

that schools often misrepresent it to parents.

This is based on AZ law, since that is where I live.

Of course the feds make the general law, then the state makes their law to

support it, then the state board of ed, then the local district blah, blah,

blah, so it will be slightly different for ea. of us underneath the umbrella

of IDEA.

15-881 Section D " For purposes of this section " extended school year " means

additional special education and related services for pupils with

disabilities to supplement the normal school year which are provided as part

of a free and appropriate public education as defined in P.L.94-142. "

Of course the actual law is a full page long, describing when it is

necessary,(prevent irreparable harm, accommodate critical learning stages)

how to determine eligibility (9 factors), what it is not for (daycare,

respite, to maximize potential).

The specific section in IDEA is

Sec. 300.309

And is only about a quarter page.

Look to your state law for specifics.

If you find out that ESY means more than extended school year (i.e.

summer school), please let us all know. This is something I've never

heard. Martha

I hate to throw a real big wrench in here (especially since I still need to

pack), but check around your state(s) and see what you can learn. Here,

we've found that our district folks go on retreats to learn how to deal with

the law. They are actually taught how to circumvent things they do not

like/want. I was floored by this information but am absolutely confident of

my source --- I guess our state requires a certain number of parents to

attend these retreats. I don't think I'll ever get over hearing about this;

meanwhile, these ignorant parents thought that we were playing with a

fair playing field... Again and again, check your information, save your

data. As one attorney said to us, it's not paranoia if it's true/necessary.

Michele,

FYI

Ohio has the " regression an lack of recoupment " of skills, clause too.

Kim-

Thanks for clarifying the ESY thing! I'll look up that section of IL

later. I think we have wording about " regression and lack of

recoupment " of skills.
