Guest guest Posted August 3, 2002 Report Share Posted August 3, 2002 If driver A is toodling along at 15 mph going south and driver B backs up out of his parking space and hits driver A, who is at fault? My son was driver A. He swerved and hit the brakes trying to miss the guy but the fellow caught the right front fender of our car. We received a letter from Driver B's insurance company today saying that our son is more than 50% at fault for his " inattention " . Therefore, they will not be paying for the damage. In addition, Driver B's wife sought medical attention following the accident and if they seek reimbursement for those expenses through their insurance company, then the insurance company will come after our insurance company or us. There were no citations issued by the rookie town cop at the scene. I was always under the impression that if you were backing up and hit someone, you were at fault. Am I wrong? This letter arrived in the mail today, so naturally I cannot talk to any insurance company or attorney until Monday! Someone make me feel better, please! My son is just sick about this.
