I have long term private insurance thru my employer. It was known and expected

that I would be followed.

So, they followed me from my home. When I had to stop to stretch to keep

driving. Filmed me at WalMart. I bought 8 things. They didn't like that I a

large bag of dog food plop into my buggy.

Be mindful to. ASK FOR HELP. Use the scooter, no matter how young you are. Have

someone load your groceries. I can't afford to tip, either. So, I tell them I am

disabled, hardly enough money to eat, so I offer to pray for them. They are

usually tickled.

Now here's the problem as it relates to my ssdi denials: this flippin video and

report and my doctor recanting my disability because her boss didn't want to be

involved MADE IT INTO MY PERMANENT MEDICAL RECORD!!  

Of course I've been denied. So, now I have to wait five more months for my

hearing with a judge. That will be a total of nearly 3 years. Plus, having to

wait 2 years more to get Medicare.

I have hired two attorneys.

Ellen,

I just wanted to say if you do not have a lawyer to help with your appeal, you

can still get one before your hearing. If you are awarded disability after your

hearing, everything goes back to the date of your original application. If you

have been steadily going through appeals for 3 years you will get medicare right

away'

It is 2 years from your application date. It took me 18 months to get

disability and I had to wait only 6 months longer before medicare kicked in.

Make sure any new medical information is submitted prior to the hearing to give

the judge a chance to review.

There will be a rehab specialist present at the hearing. The judge is

determining if you are fit for any type of gainful employment.

Keep positive thoughts. I know how stressful it is. Never give up.

When these insurance agencies or SSD (Social Security Disability) send you a

denial letter, they have to list advocacy groups or individuals that will assist

with with appeals that do not charge.

I did this for a friend when her SSD was denied and won they appeal by looking

through all the state laws and found a " medical necessity " law and I used the

exact words in that law to make the appeal and showed the expenses.

Even if your doctor is recanting your disability, the importance of keeping a

pain dairy and functional assessment be asked to be put in your medical records

cannot be denied by your Doctor, they have to put them in there as you have a

Patient Bill of Rights. Ask for the reason of the recant, always use a cane.

Now I am saying that but forget to take mine sometimes.

I do wear a Sacral Iliac belt underneath my clothes but guess I could wear it on

top. Once. I did this with my personal disability people, remember I had to

come up with documentation that my auto accident caused my problem and my

problems were from my surgery.

Well, lucky for me, one of my students was doing pictures of teachers and what

their jobs were for the " newsletter " at the school. My picture showed me

standing at a blackboard writing out assignments and goals, teaching students

how to set goals. The time and stamp date showed this was before my auto

accident and three weeks after my surgery so I could stand and teach before my

auto accident.

I had letters from my co workers, friends, family, and neighbors that stated how

I had changed and had to refuse normal activities that I normally did like

volunteering for the school, attending functions I normally loved to do, gave up

my Home Owners Association duties, gave up my tutoring after hours, and church.

This is why I am animate sometimes on this site about keeping a pain diary or

documentation. I would also get a " second opinion " from a fibromylagia

specialist or a specialist in a field specialized in your problem area.

Once I got this together and submitted it to my private insurance that this was

going to be a permanent disability, they tended to leave me alone. I have to

have a form filled out twice a year to let them know that my condition had not

changed and have to list my exams and it even reflects that I have still

declined.

I put all this in a three ring notebook so I could have a copy. It had a

" communication section " where I entered every time I visited or called my

Doctors,nurses, or anyone related to my disability and a status section that

showed if I needed to follow up or that the Doctor did not follow up.

Each long term disability company has a case manager assigned to you, get to

know them well and one time I broke down on the phone crying and asked " What is

that you need? " , tell them the situation with your Doctor and what specialist

would they suggest. Once you get them involved, they then have to do their job

for the other way. Make your own video with your telephone camera every time

you have to get someone to help, or the days you could not do normal functions.

I took a copy of my job descriptions and each task listed, I addressed why I

could not do this task. My Social Security Representative stated that what I

did made i.e. easy to be approved and that people get disapproved because they

do not address each issue. Even going to the counselor which I did not like,

assisted me. I did not want to make the statements I felt but it helped me.

Of course they always ask you about " Have you ever wanted to kill yourself? "

Well no I haven't want to do that but I have wanted go to sleep and not wake up

so I could be out of pain for a while. I was honest about the normal activities

I could not longer do, the relationships that I have suffered.

I have seen a car sitting in front of my house but it was CPS (child protective

services representative). I asked her to leave or I was calling the police as

the individual should be aware that she was

being filmed and the lady left and did not come back. I am sorry this is so

lengthy but whatever support you can get, National Fibromylagia Association.

American Pain Foundations, and Pain Topics.org websites have listings of

organizations that can assist you.

Well, I did not mean to write a book here but if I can help in anyway that can

help them get through what I have already gone through, I will be happy to help.

If you hire an attorney, they will take 25% of your back-pay, even if they do

nothing, no matter when you hire them. We hired one for my wife's case, HUGE

MISTAKE! My wife got approved without an ALJ hearing and the lawyer never did

anything (didn't even return phone calls). Cost us $3500 for ABSOLUTELY NOTHING!

You may be able to find one pro-bono. That's what I would do.

I already have an attorney provided for free by my former employer. They get

my back pay to the extent of what they paid me while I was out. My case is

so complicated that I couldn't maneuver without an attorney.

My friend with MS, which is in the automtic get SSDI was denied the first

time. He got it the next round with his attorney.

Good Luck, Good Luck, That is bad what happened to your friend and I hope he

got everything retroactively he deserved.

I was so surprised also all the letters I got afterwords that I need to make

sure if I get any income resources, it is a complex

situation even for normal (are any normal ?)

I wouldn't have done mine by myself if I hadn't had all the approved checklist

forms that seemed supportive from my Doctors, health care providers, and gone

through the steps. It really helped me out as my Mother had just passed away

two months earlier and I was helping to care for her by lying on a couch by her

side.
