Warren vs. District of Columbia Metropolitan Police Department: Duty to Act

For those of you who are gluttons for punishment and would like to read the

Warren Case, widely cited as holding no duty to respond on the part of a

If you undertake to read it, please do so with three things in mind: (1) it

applies to governmental entities which have always had a degree of soverign

immunity, (2) read with care the parts about how a special relationship is

created which may impose a duty, and (3) remember that this is a decision of

the Court of Appeals for the District of Columbia, not a U.S. Supreme Court

case.

QUERY: Is this case binding precedent for private EMS contractor cases?

Incidentally, this case is frequently cited by the National Rifle Association

as encouragement for people to arm themselves in their homes.
