There was a judge, myself, and the folks from the HMO (one lawyer, two reps). There were also another attorney, the HMO's doctor (some kind of supervising doc--not the ped), and two other people conferencing in by phone. I felt a little outnumbered, to say the least. I went first and simply presented my side. I had a big binder full of into divided into sections and brought copies for the opposing side and the judge. I think I should sell these things! Biiig binders with a table of contents and everything referenced. The judge and one of the other attorneys gave me some leeway because I didn't have a lawyer and didn't know the rules. I would present hearsay and someone would point out that I couldn't do that. Or I would talk about the medical articles and someone would say that wasn't allowed, I wasn't a doctor, but the judge would let me say it anyway (I presented it not necessarily as medical fact, but as factors that went into my decision to band ). The lawyer on the phone was a bit of an ass. He had told me earlier in the week, when I called to ask how much time I would have to present my side (so I could plan my presentation), that I would have as much time as I needed. During my presentation he objected and invoked some rule and said I was taking too long! What a liar. The judge let me finish. I wanted to prove it wasn't just a trick of the photos. They said 1) it wouldn't really be fair (too much adorable baby influence was the impression I got) and 2) since the proceeding was only tape-recorded they couldn't really record/document what the judge would be seeing. Something like that. Anyway, he didn't come in. Interestingly, when I got home that night and had some young girls over to help out with , one of them looked at his head and said, " It's all slanted! " Great. I got to cross-examine their witnesses. Thank God for TV or I wouldn't have had a clue about what to do or what to say. Thank you, Law and Order! I was in so much pain by the end that I got confused and dizzy (I have a disability, btw) and did a rotten job on the closing. I realized later I should have summed up better. Think of all the money the insurance company paid to have all those people attend the hearing, just so they could get out of paying for the band. The whole thing infuriates me, but I won't go there. It sounds like you did an excellent job presenting your case. You were outnumbered big time and that is so unfair. However, it sounds like you held your own against those big bad wolves. I'm glad the judge went easy on you. Heck, he should. You shouldn't have to be a lawyer and I really feel sorry for people that are in that situation that don't know how to present themselves. Can you imagine?? I can't remember (been reading too many posts lately) why was denied. Was it because of his age ? You must be exhausted. I encourage you to stay off the boards for awhile. I know they're addicting, like chocolate, but you need a break. You have been on an emotional roller coaster and now it's time to get off , catch your breath, kiss 's little noggin and refocus your energy. When you're back to your normal self, I expect to hear more from you. It sounds like you did an amazing job and I too agree that they spent far more money than they would've had they not denied. It is completely ridiculous but I know I am preaching to the choir here. Please take care of your self and if you do eventually write the " juice " please copy & paste in on a post here. I have too much info now not to share it with the newbies. The only reason I got through this is all the help and support from you guys. was denied because his docs said his plagio was mild and he didn't need a band. They also repeatedly said it would round out on its own. CTs measurements put him in the moderate range, and surprise surprise, it didn't round out on its own! I am so glad he got a DOC Band, and he is very lucky to have gotten the correction he did. Even the Magic DOC Band couldn't entirely compensate for such a late start, though. The remaining asymmetry, is, as everyone warned, getting more noticeable with age. Kids are now noticing it all by themselves... Yes, I held my own, I think. I really was tired and confused at the end, though, I think to my detriment. The HMOs lawyer was asking me questions and I just didn't understand what she was asking. I agree with you about how they are fighting this. If they had referred him back at six months, the helmet would have cost half of what they must have paid to have that hearing. As for parents becoming lawyers, it's not as bad as parents having to become doctors. I had to diagnose every major problem has had so far, including his tort, the plagio, and this speech delay. I am so disappointed in myself. Not for the hearing--that was pretty good, I think. But for lunch I had watermelon and V8 juice. How can I be healthy after a day like yesterday?
