ok, I was told that we need a " secondary dissemination " policy for

CCH's. Our dept doesn't give CCH's to anyone other than police officers,

we only broadcast officer safety issues. I thought maybe I was missing

something...I posted that early this am when the synapses weren't firing

quite correctly...

If you have access to an NCIC Manual, there used to be, in

the Criminal History section, some information on this.

It's been a long while since I've read it, and I'm not certain either.

One of my big concerns in transmitting this information was

that it is frequently not accurate... And many times never shows

a disposition, so you do not know if the party was ever

convicted.

In general Prosecutors and Courts have much more

need for criminal histories than police.

It's my understanding that in many larger jurisdictions the

Prosecutors and Courts have direct access to CHRI

taking the burden off of Dispatchers and Records departments.

Driving down the road today, I remembered what out NCIC auditor

kept reminding us NOT to be in violation of...

Title 18 of the United States Code.

(Something to do with releasing CHRI information)...

Of course, this is chapter after chapter, covering almost everything

in the world, so I didn't have time to search out the particulars.

While messing with it I did find some type of violation on releasing

certain drivers license information, so I'm sure the CHRI is there,

I just don't have time to find it.

A great idea Don. That CCH file is being used just as critics said it

would. Using it to determine whether or not a previous arrest as any reason

to search, detain, etc.

I've always said they should have a reason to run this, traffic stop is not

a valid reason to search a car. The Supreme Court said, " what more evidence

of speeding do you gleen from a parked vehicle? "

I'd even take this too.

Sure seems like the Constitution & Bill of Rights are suspended when some

officers go to work.

Makes no difference what state, county, municipality, some of them push the

envelope way too far.

I work for a county sheriffs/prosecutors office that also dispatches

every county program, and 6 municipality departments, we are call

takers and dispatchers traind in Emd and Bco. every day mon-Fri we

get about 10-25 names that need to be run nj master name and ncic III

for our courts system. Plus we have the officer requests always after

arrests are made though and for firearm background checks. We do not

under any circumstance Give out info over the radio. If there is an

officer safety situation we have them call us on landline. We have to

stamp each page in red ink and right who is requesting and date run.

we log everything in a big ledger and they ust sign for each one. Now

dont get me started on entering NCIC warrants. sheriffs and

prosecutors, We have to run all the background information as well.

Dl's ncic inquiries, CCH and III, plus ATS,ACS. then finally get

around to entering them. all on our one 8 hour shift. That is our SOP
