Guest guest
So the hospital and the RAC should have a business associate agreement? I understand that HIPAA gives them the ability to release their records. What gives them the ability to release our records. How do we know who when and where disclosures are made with our records? It appears that others can play a little loose with our records. Guest guest
No, you're not dense. Yes, you've got to have a BA between the RAC and each service. Austin put that out some time ago. You can use the same generic agreement and just send it out to each service. Now, I've got a question back to you: Are RAC meetings subject to the Open Meetings Act? Guest guest
U know that is a good question. We do not deny anyone access, However we do not post the meeting either. What do you think. In regards to Austin putting out the info on Business Associates. Did they make it mandatory? If so, I did not note it. In regards to HIPAA and reporting. It is mandatory to report to the state. I don't believe it is mandatory to report to the RAC. If that is true, How can the hospital provide your record to the RAC for QI without your permission?
