We switched from the APTA's recommended plan and have saved 60% for 6 therapists, massage therapist and personal trainer. Guest guest Posted September 27, 2006 Report Share Posted September 27, 2006 Yep, cheap matters but what about quality? I was sued for malpractice and HPSO from APTA was my plan. They have corporate defense attorneys they utilize in each state and the one assigned to me, out of , Mississippi was excellent. I knew the case was groundless, the pt. threatened she would sue me if we turned her into collections. We did and she did. (The attorney's told me later that more than 50% of malpractice cases are when the pt. has a money dispute and then gets an attorney). Anyways, the attorney assigned to me from HPSO was very thorough and did great depositions and discovery. It went my way so much that the plaintiffs attorney dropped the case with prejuidice. I didn't know what that meant before but it basically means that the case is so groundless that she can't re-open it even if she retains another lawyer. I just wish the attorneys would investigate to that level before filing the case in the first place! So, I was very happy with the HPSO plan. Remember, you want a company that has a complete network of corporate defense attorneys. I had one patient who once threatened to sue if we tried to collect. He told this to my receptionist. He had a reputation in the area (he was indicted for rape which I only found out about later and although he was not convicted, it certainly appeared he was guilty). I called him up and he said the same thing to me (which another witness heard on a second line). I replied that his statement constituted extortion, I had witnesses, and if he ever made such a threat or statement again, I would call the police and have him charged with extortion, a felony offense. I let him know I was dead serious and was not intimidated by him (he had intimated other threats). He never sued. Unfortunately, there are some sickos are there. Guest guest Posted September 28, 2006 Report Share Posted September 28, 2006 et al., Make sure that when you assess different liability insurance products that you make an apples-to-apples comparison between them. For instance, some carriers sell “claims-made” policies versus “occurrence policies”. Each offers a different kind of protection (and as such have different prices). (Note: With a cheaper “claims-made” policy, you will need to purchase additional nose and/or tail coverage if you ever decide to make a change (in coverage, switching employers, etc.). With “occurrence policies” <such as that from HPSO>, the nose and tail coverage is already built in the price <”further peace of mind”> .) In addition, be aware that some products may start out with a “teaser rate” then have significant built in rate increases in years 2, 3, 4, and sometimes 5, etc. Also, make sure the carrier has a good " rating " (I would hate to be covered by a company that would become insolvent anytime soon). There are many other nuances with liability products too. I would suggest you contact the Risk Management & Member Benefits Department at APTA to learn as much as you can about liability insurance (prior to purchasing or changing a policy). I’m sure they can assist you with a list of questions to ask prospective carriers as you shop their liability products. Just some food for thought. Good luck. Stuart H.
