I haven't been to a lawyer yet, but SS has told me that I'm not

eligible for disabilty because the 10 years they use for my credits

happens to be the 10 years I stayed home to be a " mom " to my kids.

This really upsets me because i worked all of my life until we

adopted our kids. both kids are severly disabled themselves and

needed a full time Mom. So, i gave up my job to care for them and

now that *I* am disabled I'm being penalized for doing the right

thing. ARGH........sometimes the govt. agencies really make me angry.

Maggie...Before you hire a lawyer, check around for a non-profit patient's

advocacy group. Start with your local MDA office and ask if they can refer you

to one. We did that and the group made things happen that we never could. It's

a chance but worth a shot....Doug/St. sburg, FL

IF YOU HAVE ANY LUCK PLEASE LET ME KNOW I WOULD LIKE TO PASS THE INFORMATION

ON.

Maggie,

Did you get a print out of your earnings and units

earned? How long have you been experiencing

significant PLS symptoms?

thanks doug, I will definately look into a local MDA and see if i can

get some help.

,

yes i got the print out from SS. My symptoms date back to around

1990.......and i was still a 'stay at home mom' at that time. I did

volunteer work in the community while the kids were at school and

therapy and finally went back to work in 1998. On the form they

sent, the years they use for credits are big and blank!

thanks.

Maggie,

From what I understood when I applied for SSDI (they

first told me I was also not eligible)is that they

need 20 units earned during the 10 years prior to your

disability date. At first they decided my disability

date was 1/1/2000 and that I did not have enough units

to qualify when going back 10 years. My attorney was

able to get them to change my disability date to

12/31/99 (one day earlier) and then I had enough units

earned. But they won't volunteer that! In fact they

were very rude to me and wouldn't even explain why I

didn't have enough by their calculations, wouldn't

explain how they calculated it. It took an attorney

to get them to change their tune. My attorney took

the case contingent on my getting approval for

benefits. If I didn't qualify, they wouldn't get a

thing. If I did, they would get a minimum of $1,500

or 10% of by back benefits, whatever was greater.

SSDI ended up setting the fee they were entitled to at

$1,200 and I am paying them $200 a month out of my

$1,178 monthly benefit. I would consult with an

attorney that specializes in SSDI cases. It is

possible that you could go back to a disability date a

few years ago and still have enough credits. I'm not

sure how far back you can go. And you only need to

earn $700 in a year to get 4 units. They used to use

a different way to calculate the units, on a quarterly

basis. An attorney should be able to tell you if you

possibly have a case, and they should not charge you

for the consult. You can't lose by checking it out.

Good luck,

Thanks to all who replied to my question regarding SSDI. We have called for

an applicatin and have an appointment with our regional office next month.

Our main concern since we have private, non-group insurance, is that we need

to get SSDI as soon as possible so we can apply for Medicare as soon as

possible. I think it is going to be a lot of trouble, but all they can say

is NO.

Our Neurologists is all for it. So will let all of you know what turns up.
