Conflict question

Hello:

A former client's wife has asked me to see her husband again. He is

getting home health nursing but the home health PT has d/c'd the

patient. The wife anticipates that nursing will soon be d/c'ing the

patient as well.

She wants to pay me cash until the patient is d/c'd from home health at

which time, I will re-eval the patient, do a new plan of care and begin

billing Medicare.

My question is this. Can I legally and ethically bill the patient for

less than what I would bill Medicare?
