I would encourage California to go for statutes that protect both the

titles of dietitian and nutritionist, have a strong practice act that

identifies what only those individuals can do, clearly delineates what

those in other health professions and the public can do with regard to

nutrition and provides for consequences for practicing nutrition and

dietetics without a license.

My advice comes to you from my experience in Montana. We obtained

licensure of nutritionists in 1988. At the time we sought licensure for

dietitians. Early on a legislator asked " What is the difference between

a nutritionist and a dietitian? " He went on to ask If you are licensed

as dietitians what is to prevent an unqualified person from calling

himself a nutritionist to get around the law? " Without that remark the

committee rewrote the bill for mandatory licensure of RDs as

nutritionists. At the time there was some opposition from the

supplement and health food industries although it was not as

sophisticated as other states seeking licensure have experienced in

recent years. Our lobbying, by contrast, was very professional. There

were no CCNs in the state then. We passed the bill in one 90 day

session using tremendous grassroots efforts from RDs.
