Guest guest Posted June 22, 2006 Report Share Posted June 22, 2006 Dear Forum, Let us talk about some of the ongoing violations of Human Rights by the NACO Policy, which must be rectified immediately to achieve the ultimate goal of our National Aids Control Program according to International Human Rights Standards and the Nature of State Obligations. As an average Citizen not as any Lawyer, few questions strike me all the time as a man living with HIV with the help of 2nd line Anti Retroviral Drug( ARD) supported by someone with an unknown future. But, it is known to me that as per policy if any Donor wishes to support any life with ARD, he/she has to continue his/her commitment throughout the life of the Stakeholder and for the same policy no donors are supporting with ARD because life long liability. The policy simply allowing anybody living with HIV, who needs 2nd line ARD in India, to die without treatment. So, within the policy there is no scope of immediate life saving 2nd line ARD support which may give any chance to a person living with HIV, to be self sufficient with any Transitional Support to the Right to Life ! On the other hand , the same policy is moving towards National Blood Safety to control HIV and other diseases in a broader aspect, but it do not allow Blood Banks to inform any Donor about HIV status, if found, except destruction of the Donated Blood. Is this not the violation of the Right to know or the Right to freely receive Information or the Right to the highest attainable standard of Physical and Mental Health or the Right to Social Security, assistance and Welfare? The impact of unbalanced HIV Awareness Programs is the continuation of the SOCIAL STIGMA regarding HIV. Even today, there is lack of awareness on HIV transmission in Window Period through the transfusion of Certified HIV Free Blood from recognized Blood Banks. In the same way, the practice of International GIPA (Greater Involvement of People Living with Aids) agreement signed in the year 1994, with the tokenistic approach, even today! This is violating the Right to freedom of opinion and expression and the Right to freely receive and impart Information and the Right to share in scientific advancement and its benefits of the people living with HIV! Likely, the ongoing trend to document case studies for different purposes (May be for the Research) through the people living with HIV in exchange of very small amount money without proper Informed Consent for the particular purpose!
