MAKIING THE IDEA 2004 WORK FOR YOUR CHILD

The Individuals with Disabilities Education Act (IDEA) has been the main Federal program that authorizes State and local financial assistance for “special education†and “related services†for our students with disabilities since 1975. The IDEA has established and enumerated the rights of students and parents in the special education process, along with the 1973 Section 504 of the Rehabilitation Act (29 U.S.C. 794 with regulations at 34 C.F.R. 104) and the 1992 Americans with Disabilities Act (42 U.S.C. 12101 with regulations at 28 C.F.R. 35). It has been amended several times (from the Education of the Handicapped Act, to the Education for All Handicapped Children Act, to the IDEA, to the IDEIA) but the current Statute -- Public Law 108-446 – which is generally being referred to as IDEA 2004 – has the most sweeping amendments in the entire 30 years. Some major changes which we will describe and comment on below are: -- IEP meetings which now might be conducted over a video hookup instead of having parents meeting face to face with school personnel, and making further changes to the IEP without actually holding another IEP meeting, both of which this Congress felt would lessen “the unnecessary paperwork burden,†-- Giving local school districts greater flexibility in reviewing a student’s progress by replacing what Congress has referred to as “bureaucratic benchmarks and short-term objectives†and relying on the No Child Left Behind System – with the House of Representatives Education Committee actually claiming that NCLB measures a student’s actual academic progress better than the current measures required on IEPs, -- Asking States to create their own plans on how they will meet the requirements of the Federal law, -- and allowing school district attorneys to consider suing the parent under certain circumstances and attempting to force that parent to pay the school board’s attorneys’ fees and the school board’s costs of the litigation.This information is educational and not intended to be legal advice.http://www.reedmartin.com/idea2004overview_manual.htm
