They can only use the IDEA. In one recent workshop that did he was asked not to take time on Section 504 because it did not deal with special education. The school personnel at that workshop were very knowledgeable and supportive of our students with special needs but had been told, and honestly believed, that Section 504 had nothing to do with special education. Actually Section 504 was our first special education statute. In 1971, a mom in Minneapolis took her daughter down the street to enroll her in elementary school. When a school person recognized the facial configuration of Down Syndrome she waved the parent away, telling her they had nowhere to serve her child in the school district. The mom called her father for help. We have all done that, but this father was Senator Hubert Humphrey and he introduced Section 504 on the floor of the Senate. knows He was there. The statute was passed, but then vetoed by President Nixon in 1971, passed in 1972 and vetoed again and then passed again in 1973 and this time the veto was overridden. We had a long fight to get the Regulations written and published but Section 504 was finally up and running. had the first administrative complaint in the nation under Section 504. We know because the Feds contacted him and said this is the first complaint and we are going to have to go slow on this. had the second Federal court case on 504 in the nation and had the first case at the U.S. Supreme Court on 504. Since he won each of those we are pretty sure that 504 relates to special education situations.
