Tina,

I would suggest that you write another letter mentioning that you are

following up on your request in the last letter. Then, mail this letter

Return Receipt Requested. The others can tell you which part of the IDEA to

quote. It is your legal right to have a copy of her total file. They may

make you pay for the copying but they have to do it for you.

Tina,

If you request all files from every location (i.e. principal's private

file, school psychiatrist's file, therapists files, etc.), there should be

every piece of paper ever written about her in it. When I got 's

file it included formal papers like her report cards but it also included all

letters, evaluations, and notes written about her and taken at any meeting

concerning her. The notes are the most interesting to read.

Opportunity to Examine Records 300.501, 300.562-300.569

You must be given an opportunity to inspect and review all your child's

records. They may ask for you to pay for copy fee's but they can charge you

for just looking at them or searching them.

They MUST respond in no more than 45 days, but a quick response is required

if the info is needed for IEP meetings or due process hearing.

That's brief but maybe it will help you,

thanks, I have read this on this list before, that is why I requested it.

But I was taken aback when the pricipal was confused as to what I was

asking for. Can you or someone on the list tell me exactly what documents

should be in her file.

Tina,

I am no expert but I would write to the principal, always Return Receipt

Requested (I have done this so many times I have my own supply of cards on

hand), and ask her to state the regulations that do not allow them to copy

notes. I would also specifiy that I would like her reply in writing. If she

tries to call you or talk to you in person about this, I would tell her that

you would like her reply in writing for your files.

I am sure Kay, Celeste or Cheryl can give you more specific things to do

but I hope that this helps.

I've never really seen JD's complete file, but I got to hand carry a good

chunk of it when we moved, and of course, I peeked at that. I found that JD

had failed his vision screening test, but that nobody had bothered to tell

me. I guess they felt this deaf child who relied so much on speechreading

didn't need his vision? The poor kid is farsighted so if he got close enough

to hear it, he couldn't see it, and vise versa.

There were attendance records, standardized testing records, teacher's notes

(to whom, I'm not sure), samples of his work, stuff like that. I know it

wasn't his complete file because there were no copies of his IEP in there

(not even his current one).

Elenor & Kay,

I did not specify files from every location I stated " a complete copy of

her school files " . I guess I will clarify with the principal " all files

from every location " .

The principal mentioned some notes from every teacher that she has had.

But she told me she could not copy those. I can read them but they " could

not copy them " .

Is this odd? Why wouldn't they be able to give me a copy?
