§ 99.11 May an

educational agency or institution charge a fee for copies

of education records?

(a) Unless the imposition of a fee effectively prevents a parent or eligible student from exercising

the right to inspect and review the students education records, an educational agency or institution may

charge a fee for a copy of an education record which is

made for the parent or eligible student.

(B) An educational agency or institution

may not charge a fee to search for or to retrieve the education

records of a student.

(Authority: 20 U.S.C. 1232g(a)(1))

CONNIE'S STRATEGY

TIP: Write to your Superintendent and ask for their written

policy and the dated board minutes that adopted the policy regarding access to records, including

any fees. I would also ask for the name of the official responsible for complying with

record requests.

FERPA Response to Parent About Right to Amend an Educational

Record

FERPA and School Rights to Release Information from Student's

Educational Records

Generally,

schools must have written permission from the parent or eligible student in order to release any

information from a student's education record. However, FERPA allows schools to disclose those records,

without consent, to the following parties or under the following conditions (34 CFR §

99.31):

School officials with legitimate educational interest;

Other schools to which a student is transferring;

Specified officials for audit or evaluation purposes;

Appropriate parties in connection with financial aid to a student;

Organizations conducting certain studies for or on behalf of the

school;

Accrediting organizations;

To comply with a judicial order or lawfully issued subpoena;

Appropriate officials in cases of health and safety emergencies; and

State and local authorities, within a juvenile justice system, pursuant to specific State

law.

CONNIE'S STRATEGY TIP:

Write to your Superintendent

by certified mail and ask for a list of names and positions of school officials with legitimate

educational interest that have access to your child's educational file.
