Not at this time. If I ever get some free time, there may be in the future.

If you go to

www.dogpile.com and type in " sample IEP complaint letters, you will get some

sites who have a few sample letters up, but I found none for filing a

complaint because of non-implementation of the IEP.

I don't know about any letters. I do know that pursuant to the 1997

amendements, the ability of the SEAs was strengthened relative to the

award of compensatory ed or other remedies relative to a complaint. So

the first step in your process is to collect/create all the

documentation you can that the IEP is not being implemented. (Like

send a letter to the gormless twit who said she " doesn't have time to

make sure Gabe gets his speech and OT time, " confirming this idiocy.)

Then file a formal complaint pursuant to your state complaint

procedures (see your state rules for sped if you are not familiar with

them) enclosing all the documentation, for their edification, asking

for compensatory ed as the remedy.

No promises that it will work, but that's how the process begins.

DUH! I read that too quickly the first time, and throught you were

asking for any OSEP/OCR letters that addess the issue of compensatory

ed. After another senior moment, and reading Kay's comment, I realize

you want a sample letter of complaint. Well, ok, then, no problem. I've

only written a million of 'em. See the following. (Remember, I've

changed names and details to make it *mythical* for you.

Dear Mr. Boss:

This letter is a formal complaint against the Yortown Community

Schools, on behalf of our son, Smart. is a 14 year old hard

of hearing student in the eighth grade. He attends Monroe Junior High

School and also receives special education programs and services

through the Yortown Program for Deaf and Hard of Hearing Students. We

allege that Yortown Community Schools violated the requirements of the

Individuals with Disabilities Education Act and the New York

Administrative Rules for Special Education.

Allegation #1: Failure to provide related services

's IEP, (attached) requires that he receive speech therapy twice

per week, 30 minutes per session, and PT once per week, 45 minutes per

session. Since January 15, 2000 no speech therapy has been provided to

him at all, and he has only had 2 session of PT, each for 25 minutes.

Those sessions occured on January 26 and February 7, 2000. The IEP

clearly states that is to receive services from August 28, 1999

through June 12, 2000. The principal of Monroe Junior High School, Ms.

Mona Forver, informed us that speech services are not available while

the speech therapist is on maternity leave. (See attached letter of

confirmation, dated January 30, 2000.) 's homeroom teachers stated

that she will only allow to go to PT if she feels that has

been particularly clumsy during the week (See attached letter of

confirmation, dated February 12, 2000.) We do not believe that this

meets the requirements of 's IEP, and thus violates both the IDEA

and the NY Administrative Rules for Special Education. We request that

you direct Yortown Community Schools to immediately begin providin

Rogger with all the therapy services to which he is entitled, as per

his IEP. Additionally, we request that you direct the district to

initiate the provision additional hours Speech Therapy and PT,

equivalent to the hours missed, to compensate for the missed services,

to which he was entitled. We further request that the schedule for the

provision of these compensatory services be approved by us before

taking effect.

Allegation #2: Failure to provide supplementary aids

's IEP requires the provision of an FM unit. He is mainstreamed

for all academic classes, except English. Beginning with the second

semester of this academic year, his math teacher has been Mr. C. U.

Inhades, who refuses to wear the FM microphone. As a result, is

unable to understand what he is saying, and is falling behind in math.

He failed the first two quizzes of this semester. has always done

well in math and claims that he failed the quiz because Mr. Inhades

will not wear the FM microphone, so he is unable to benefit from any

instruction given to the rest of the class. We request that you direct

Mr. Inhades to wear the FM microphone at all times when is in his

class. We further request that you direct the district to either

provide with after-school tutoring, or reimburse us for the cost

of a private tutor, to compensate for the instruction missed

while Mr. Inhades was not wearing the FM microphone. We also ask that

you direct Mr. Inhades to allow to take the first two quizzes

over again, after he has completed the tutoring.

We request that you investigate the substance of our complaints, and

direct Yortown Community Schools to provide compensatory education and

services, as suggested above, if these allegations are found valid.

Please respond to us in writing.

Please do not hesitate to contact us if you need additional

Further to what Celeste wrote - I agree with the need

for documentation. I also like to copy everyone in

the district on my correspondence -- you never know

who might help you. It was obvious to anyone who

read my trail of documentation that the FM units were

not working more than they were working and no one

seemed to take responsibility. This letter got the

Superintendent of Schools involved with my children's

FM units and now the teachers and all involved realize

the importance of implementing that part of the IEP.

Luckily I didn't have to go through with the suit for

compensatory education, but I was so frustrated at the

time, I certainly would have.

Dear Mrs. XXXX;

As you are aware, there have been many problems with

both children’s FM units since the start of the school

year (refer to my letters dated September 15,

September 21, September 26, October 8 and October 18,

copies attached.) Obviously this situation cannot go

on. The FM unit (as included in their IEPs) is

necessary for XXXX and XXXX to receive an appropriate

education -- each day that the unit is not properly

functioning, they are not receiving the education that

they are entitled to under law. It is a very serious

matter, which I cannot ignore.

As per my October 18th letter, I offered to bring

XXX's FM unit to XXXXX, the school audiologist, after

school today. Not only did I not receive the courtesy

of a response to that offer, when my father called

today to check with you, he was told you said you

“were too busy to speak with him because you were

filling out a report for the state.” And I actually

thought that the education of students was the number

one priority of the school district!

As far as I am aware, the problems that remain with

the FM units are:

* The rechargeable batteries in XXXX's unit do not

hold the charge the entire day.

* The volume setting in XXXX's unit needs to be

adjusted to make the teacher’s voice louder (without

this adjustment we are defeating the purpose of the

unit.) This must be done internally by XXXXX, the

school’s audiologist.

* XXXXX remains without his student’s mike for nearly

two weeks now.

I have no desire to continue writing a letter a week

and calling regarding FM problems. And I certainly

have no desire to bring the district to court for

compensatory education, but I will if I have to. I

just don’t know what else to do. Would you please

give this issue some priority, so the children can

hear and learn. I will be happy to help in any way.

Actually, I didn't have to write the letter. I told them since they were

having so much trouble with interpreters that I wanted in summer

sessions this year with the TOD and the SPL, and they agreed, wrote it in

the IEP and that was that. If anyone has something tho', and would like to

share it, I would love to add it to my site!

Hi Sherry,

I was wondering if anyone was compiling a list of the different sample

letters Celeste has given us from time to time. I try to save them and then

thought it would be wonderful if there were a web site that had the letters

on it. Then knowing you and Kay decided I should ask as probably one of you

already thought of this and were already doing it.

I knew Kay had some on there about insurance coverage of aids and that we

have some sample IEP's available. I know it takes a lot of time to keep up

with all the information and for you and Kay to keep your sites up to date

but you are both appreciated very much.

Gabe's OT services and speech services are both things he is to be doing on

the computer. The computer records the day and time he does the exercises.

The school is to make sure he has his 20 minutes a day to do them and send

me reports each week. I have had nothing since the teacher went on

maternity leave.

My only documentation would be lack of documentation. The last reports I

received are dated about three weeks ago. The teacher told me on the phone

she was sorry she hadn't time yet. All other knowledge is from Gabe who

tells me the teacher tells him there is no time to do it.

Thanks Celeste. I've just built a special section on the site for sample

complaint letters. Now everyone just has to wait for me to upload the

changes. One thing I want to mention to everyone, since the " Your Rights "

section of the site is getting so large I've had to move it into its own

folder so I can keep track of everything. This means that when I make my

next update (I hope to do that later today), all the URLs for any of the

pages in this section will change. For a quick correct, make the changes as

below:

In other words, between the org/ and the name of the page, insert " rights/ "

(without the quote marks). ;-)

I'm glad to say it looks like the changeover to the new host for the site

Thanks Barb, it does take a bunch of time and work. I will be moving my

site within the next week, and will let you all know it's new address soon.

I ran out of room on GTE and I have wanted to add stuff for awhile, now I

can.

If there are other kinds of sample letters people want (like a request

for an independent evaluation; request to examine records; notice of

disagreement pursuant to a due process hearing request) let me know. I

have done all of those, of course, but I developed samples for the work

I did for Gally's upcoming website. Gally will hold the copyright on

those, once I am paid, but I can change them around enough so that

there won't be any copyright hassles. Let me know.

Of course, once that site is up (heaven knows when) you can link to all

that stuff.

thanks Celeste. yes, I've had people ask about all of those. Either way is

fine for me. I joined Kay's web server, so I will have a ton or room for

You three are the best. I was wondering if a page like this existed and

thought it would be wonderful if it did. You went from a hope in my mind to

reality in just a few days. What a group!!!

We aim to please! There are many things I want to add all the time, and I

get so busy that things and ideas slip my mind. It's great when we get

these little kick in the pants to remind us some times.
